    PURPOSE AND EFFECT: The purpose of these repeals is to consolidate and streamline regulations related to shrimp into Chapter 68B-31, F.A.C., so they are easier for the public to find and understand. The effect of these rule repeals and related rule amendments would repeal these rules and move seasonal and spatial restrictions on the use of shrimp trawls and consolidate these regulations into Florida’s shrimp regulations in Chapter 68B-31, F.A.C.

    SUMMARY: These rules would be repealed and the language moved so that specific shrimp regulations applicable to Taylor County and Southwest Florida from Chapter 68B-38, F.A.C., (Shrimping and Trapping: Closed Areas and Seasons) are placed into Chapter 68B-31, F.A.C., (Shrimp) so they are easier for the public to find and understand. These repeals accompany proposed rulemaking for Chapter 68B-31, F.A.C.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the nature of the rule and the preliminary analysis conducted to determine whether a SERC was required.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
