64B13-5.001(2)Hours Requirement
The Board of Optometry hereby gives notice: David Brancati, OD, filed a Petition for Variance or Waiver on February 12, 2015, published February 17, 2015, in Vol. 41, No. 32, of the Florida Administrative Register, regarding subsection 64B13-5.001(2), F.A.C., which requires that a licensed optometrist provide 30 hours of continuing education, six of which must be approved as transcript quality courses each biennium. The Board considered the Petition at a duly-noticed telephonic, public meeting held on February 27, 2015.
The Board’s Order, filed March 11, 2015, granted the Petition, finding that the purpose of the underlying statute, §463.007, F.S., has been achieved and application of subsection 64B14-5.001(2), F.A.C., would create a substantial hardship and violate the principles of fairness under these specific circumstances.
