Notice of Denial of Request to Conduct Public Workshop

The Secretary of the Department of Corrections, pursuant to paragraph 120.54(2)(c), Florida Statutes, having carefully reviewed and considered multiple “requests to hold a public workshop” has made the following findings:

(1) The requestor incorrectly asserts that the Department “ is attempting to remove my [the requestor’s] rights to be notified.” The rule change removes language that merely reiterates or paraphrases statutory material which is prohibited by paragraph 120.545(1)(c);

(2) The requestor incorrectly asserts that the Department is attempting to “remove the notification to the Joint Administrative Procedures Committee.” The rule change removes language that merely reiterates or paraphrases statutory material which is prohibited by paragraph. 120.545(1)(c);

(3) The requestor lacks standing and direct knowledge to allege a grievance related to the notification effectiveness to inmates via posting of a memorandum.  Furthermore, the rule change does not substantially change the existing rule that would warrant a public workshop; and

(4) The costs associated with such a workshop that would ultimately be borne by the citizens of the state of Florida is unnecessary.

Therefore, the Secretary of the Department of Corrections, pursuant to paragraph 120.54(2)(c), having carefully considered the request for a public workshop and otherwise being fully advised, DENIES the request for a public workshop.
