    61G20-1.001Florida Building Code Adopted

    PURPOSE AND EFFECT: House Bill 89 (2023), House Bill 327 (2023), Senate Bill 154 (2023), and Senate Bill 1068 (2023), made changes to statutory provisions which are included in or addressed by the Florida Building Code. In order to reflect these changes, the Florida Building Commission must amend the Code. Additionally, section 553.73(8)(b), F.S., provides a mechanism for the Commission to issue errata to the Code to list demonstrated errors in its provisions. The Commission solicited public comment and identified errors in the Code to be corrected. The Commission also approved amendments which will incorporate equivalent plumbing standards to address the issues addressed by Emergency Rules 61G20ER23-3 and 61G20ER24-1, F.A.C.

    SUMMARY: The proposed amendments will incorporate various statutory provisions into the Florida Building Code, correct identified errors, and address the equivalency of standards.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The proposed amendments are not anticipated to have an effect on regulatory costs, as they are merely incorporating certain legislative provisions into the Florida Building Code and correcting minor errors.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
