    73C-23.0031Definitions

    PURPOSE AND EFFECT: Chapter 73C-23, F.A.C., implements the Florida Small Cities Community Development Block Grant Program set forth in sections 290.0401-290.048, F.S. The rules and incorporated forms will be amended to include infrastructure planning as an eligible activity under the Program.

    SUMMARY: The proposed rule updates parts 2, 4, and 7 of Form SC-60, Application for Funding, which form is incorporated by reference through the link in Rule 73C-23.0030, F.A.C. The proposed rule will amend those parts to include infrastructure planning as an eligible activity under the Florida Small Cities Community Development Block Grant Program. The proposed rule will also update the definitions of “Application Cycle” and “Completeness Period” in Rule 73C-23.0031, F.A.C., regarding application timeframes.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Agency has previously reviewed the statutory requirements and determined that the proposed amendments to Rules 73C-23.0030, F.A.C., and 73C-23.0031, F.A.C., will not have an adverse impact or associated regulatory cost that exceeds any of the criteria set forth in section 120.541(2)(a), F.S.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    73C-23.0031 Definitions.

    Terms used in this chapter which are not defined herein have the meanings as set forth in the authority incorporated by reference in rule 73C-23.0030, F.A.C. Terms defined herein have the following meaning:

    (1) through (4) No change.

    (5) “Application Cycle” means the 45-day period during which the Department will accept applications as specified in the Notice of Funding Availability published in the Florida Administrative Register.

    (6) through (11) No change.

    (12) “Completeness Period” means the 14-day 21-day period that the Applicant has to respond to any requests for additional information related to its Application for Funding.
