PURPOSE AND EFFECT: To amend the list of approved product evaluation entities to conform to recent changes made to s. 553.842, F.S.

SUMMARY: R. 61G20-3.008(1)(a), F.A.C., contains an exclusive list of approved evaluation entities in the State Product Approval Program as prescribed in s. 553.842(8)(a), F.S. The rule will be amended to add Underwriters Laboratories, LLC and Intertek Testing Services NA, Inc. as approved evaluation entities in the rule to conform to changes made to s. 553.842(8)(a), F.S.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Commission conducted an analysis of the proposed rule’s potential economic impact and determined that it did not exceed any of the criteria established in s. 120.541(2)(a), F.S.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(1) Approved Product Evaluation Entities. Approval by the Commission is limited to the scope   established by Section 553.842, F.S.

(a) The following entities are approved evaluation entities:

1. The National Evaluation Service (NES);

2. The Miami-Dade County Building Code Compliance Office Product Control Division (MDCBCCOPCD);

3. The International Code Council, International Evaluation Services (IES); and

4. The International Association of Plumbing and Mechanical Officials Evaluation Service (IAPMO).

5. Underwriters Laboratories, LLC

6. Intertek Testing Services NA, Inc.
