64B5-2.0152:Licenses Granted Based on The American Dental Licensing Exam from Other Jurisdiction: Full-time Practice Requirements

The Board of Dentistry hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on April 17, 2015, by Flavio A. Kottar. The Notice of Petition for Waiver or Variance was published in Volume 41, Number 79, of the April 23, 2015, Florida Administrative Register. The Petitioner was seeking a waiver or variance of paragraph 64B5-2.0152(1)(a), Florida Administrative Code, entitled, “Licenses Granted Based on The American Dental Licensing Exam from Other Jurisdiction; Full-time Practice Requirements, “ which requires that applicants who are relocating to this state based on scores from the ADLEX that was administered in a jurisdiction other than Florida, must engage in the full-time practice of dentistry, which is defined as completion of one thousand two hundred (1,200) hours of practice within the geographical boundaries of Florida within the first year of obtaining a Florida dental license. The Board considered the instant Petition at a duly-noticed public meeting, held May 29, 2015, in Gainesville, Florida.

The Board’s Order, filed on June 23, 2015, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute would be met by granting a variance or waiver from paragraph 64B5-2.0135(4)(c), F.A.C. The Board further finds that Petitioner failed to establish that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
