    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 40, No. 77, April 21, 2014 issue of the Florida Administrative Register.

    These changes are based on written comments of the staff of the Joint Administrative Procedures Committee, timely submitted written materials, and input at the public hearing.

    1. The definition of “online course” in subsection 69B-227.130(19) has been changed to mean a self-study course delivered via the internet or other computer network.

    2. A definition of “self-study” has been added in subsection 69B-227.130(26) to mean a term used to describe correspondence and online courses. Subsections 69B-227.130(26) and (27) have been renumbered as subsections 69B-227.130(27) and (28).

    3. When adopted, Rule 69B-227.160 will read:

    (1) Instructors must be registered with the Department prior to teaching any classrom course subject to this rule chapter. To qualify as an instructor, an individual must meet the education or experience requirements set forth in subsections (2), (3), or (4) below. The individual shall submit an application for approval and registration on Form DFS-H2-398, “Instructor Application,” which is incorporated by reference in Rule 69B-227.290, F.A.C., and shall be accompanied by documentation supporting the education or experience requirement.

    (2)(a) For all pre-licensing courses except bail bond, a registered instructor must possess at least one of the following requirements, subject to the limitations imposed in Rule 69B-227.310, F.A.C.:

    1. At least ten (10) years working experience in the subject matter in the last twenty (20) years.

    2. At least two hundred (200) hours instructing in the subject matter in the last four (4) years.

    3. CPCU or CLU designation.

    4. Risk Management Insurance degree.

    5.Florida Bar membership with two (2) years experience litigating the subject matter; or

    (b) For all pre-licensing courses except bail bond, a registered instructor must possess at least two (2) of the following requirements, subject to the limitations imposed in Rule 69B-227.310, F.A.C.:

    1. At least five (5) years working experience in the subject matter in the last ten (10) years.

    2. At least forty (40) hours hours instructional experience in the last four (4) years.

    3. Bachelors degree or higher in the subject matter.

    4. Professional designation recognized by the insurance industry in the subject matter.

    (3) For bail bond courses, an instructor must meet the qualifications as set forth in Section 648.386(4), F.S., subject to the limitations imposed in Rule 69B-227.310, F.A.C.

    (4) Instructor Requirements.

    (a) Registered instructors for approved classroom courses must display a valid government-issued photo I.D. to any Department representative who conducts a course audit.

    (b) A registered instructor is allowed to teach for more than one approved and registered provider.

    4. Paragraph 69B-227.170(3)(a) has been changed to read: The course must be taught by an instructor registered with the Department who meets the requirements set forth in Rule 69B-227.160, F.A.C.

     

    5. The name of the form in subsection 69B-227.190(1) has been changed to “Attendance Roster Detail” and the citation in subsection 69B-227.190(2) has been changed from Rule 69B-228.180 to Rule 69B-227.290, F.A.C.

    6. In Rule 69B-227.240, the words “and monitored exams for correspondence courses” have been deleted.

    7. In paragraph 69B-227.290(4)(d), the name of the form has been changed to “Attendance Roster Detail.”

    8. The last sentence in Rule 69B-227.340 has been changed to read: The Department shall disapprove the course if the provider fails to correct the deficiencies within thirty (30) days from the date of the notice of deficiency.

    9. The citation to Section 626.171(5), F.S., has been changed to Section 626.171(6), F.S., on Forms DFS-H2-398, DFS-H2-1668, and DFS-H2-1137. The effective date of Form DFS-H2-1668 has been corrected to 2/2006.
