PURPOSE AND EFFECT: The purpose of the rule amendment is to update the language for approval of continuing education providers.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

THE FULL TEXT OF THE PROPOSED RULE IS:

 

64B4-6.004 Approval of Continuing Education Providers.

(1) through (4) No Change.

(5) The Board retains the right and authority to review, audit and/or monitor the provider and individual  programs, to include the right to and review records and course materials given by any provider approved pursuant to this rule.

(6) The Board shall rescind the approved provider status or rescind or reject approval of individual programs if the Board’s review of the the provider or their individual programs determine that the provider:

1. Failed to conform or abide by the rules of the Board;

2. Failed to provide individual programs which are in compliance with the rules of the Board;

3. Failed to provide individual programs which meet the criteria established in section (2)(a) above; or

4. Is in violation of any of the provisions of chapter 456 or 491, F.S., to include any of the provider’s faculty membersThe Board shall rescind the provider status or reject individual programs given by a provider if the provider disseminated any false or misleading information in connection with the continuing education programs, or if the provider failed to conform to and abide by the written agreement and rules of the Board or if the provider or its faculty member(s) are in violation of any of the provisions of chapter 456 or 491, F.S.
