    69A-3.012Standards of the National Fire Protection Association and Other Standards Adopted

    PURPOSE AND EFFECT: Section 633.202(4), F.S., requires the State Fire Marshal to update, by rule, the Florida Fire Prevention Code every three years. Section 633.202(2), F.S., requires the State Fire Marshal to adopt the appropriate editions of the National Fire Protection Association’s (NFPA) Standard 1, the Fire Code, and NFPA Standard 101, the Life Safety Code®, by reference.

    SUMMARY: The proposed amendments will update the Florida Fire Prevention Code to include appropriate NFPA standards and promulgate the triennial update of the Florida Fire Prevention Code as directed by section 633.202, F.S.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department’s economic review for this rulemaking.

    69A-3.012 Standards of the National Fire Protection Association and Other Standards Adopted.

    (1) Except as specifically modified by statute or by the State Fire Marshal’s rules, the “Florida Fire Prevention Code, 8th 7th Edition (20232020),” which is comprised of NFPA 101, the Life Safety Code® ,(Florida 20212018 Editionedition) and the Florida specific edition of NFPA 1, the Fire Code, (2021 Florida Edition 2018 edition), are hereby adopted and incorporated by reference and are applicable to those buildings and structures specified in paragraphs (a) and (b), of subsection (1), of Section 633.206, F.S.
