NOTICE IS HEREBY GIVEN that on July 31, 2024, the South Florida Water Management District (SFWMD), received a petition for variance (Petition) from SCP Ironhead, LLC, 2570 Commerce Parkway, North Port, Florida 34289 (Petitioner), for the proposed Ironhead Mitigation Bank, located in Collier County, Florida (Variance Application No. 240731-44978, regarding Environmental Resource Permit Application No. 230616-39089). The Petition seeks a variance from the requirement to substantially comply with and utilize the standard construction and implementation standby trust fund agreement (Standby Trust Fund) and standard perpetual maintenance trust fund agreement (Trust Fund) forms incorporated within and required by paragraphs 62-342.700(10)(b), and (11)(b), F.A.C, respectively. The Petition seeks to modify these financial assurance forms by replacing them with forms that include the U.S. Army Corps of Engineers as a joint beneficiary. Any interested person or other agency may submit written comments on the Petition within 14 days after publication of this notice.
