    69G-20.035REPORTING SAFE DEPOSIT BOX CONTENTS

    PURPOSE AND EFFECT: Section 717.117(1), F.S., provides that every person holding funds or other property, tangible or intangible, presumed unclaimed and subject to custody as unclaimed property under this chapter shall report to the department on such forms as the department may prescribe by rule. The Division of Unclaimed Property has adopted Form DFS-UP-155 to be used to report the contents of a safe deposit box.

    SUMMARY: The proposed rule amendment will update Form DFS-UP-155.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department’s economic analysis of the potential impact of the proposed rule amendment determined that there will be no adverse economic impact or increased regulatory costs that would require legislative ratification.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
