PURPOSE AND EFFECT: The Board proposes the rule to reflect the new requirements in s. 456.0145, F.S., regarding licensure by endorsement and will now be required to apply to the Department of Health using a new form incorporated in the rule titled Mobile Opportunity by Interstate Licensure Endorsement (MOBILE).

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board concluded that this rule change will not have any impact on licensees and their businesses or the businesses that employ them. The rule will not increase any fees, business costs, personnel costs, will not decrease profit opportunities, and will not require any specialized knowledge to comply. This change will not increase any direct or indirect regulatory costs. Hence, the Board determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

64B8-42.001 Licensure by Endorsement.
An applicant for licensure by endorsement pursuant to section 456.0145(2), F.S., shall submit his or her application DH-MQA-5103, Revised 7/2024 Mobile Opportunity by Interstate Licensure Endorsement (MOBILE), which is incorporated herein by reference and which may be obtained from FLRULES WEBSITE LINK, the Board office, or at http://www.flrules.org/Gateway/reference.asp?No=Ref- . Applicants for licensure shall meet and comply with all requirements in Section 456.0145(2), F.S.
Each applicant for certification as a dietitian/nutritionist by endorsement shall file the Application for Dietitian/Nutritionist Licensure, DOH Form DH-MQA 1161, Rev. 10/2020, incorporated by reference, which can be accessed at http://www.floridahealth.gov/licensing-and-regulation/dietetic-nutrition, or at https://www.flrules.org/Gateway/reference.asp?No=Ref-12603, and demonstrate the following:
(1)(a) That she or he holds registered dietitian credentials issued by the Commission on Dietetic Registration of the Academy of Nutrition and Dietetics, or
(b) That she or he holds certification or licensure to deliver dietetic and nutritional practice in another state, district, or territory of the United States; such certification must have been granted to requirements determined to be substantially equivalent to or more stringent than the requirements in Florida.
(2) That she or he is not under investigation, involved in disciplinary proceedings in any jurisdiction, or otherwise disqualified by reason of violation for any act which is a violation of Chapters 456 and 468, Part X, F.S., or the rules promulgated thereunder.
