6A-2.0040Sanitation Standards in K-12 Private Schools
The Department of Education hereby gives notice: that on July 21, 2023, the department received a Petition for Variance from 468.3.5.1 and 468.3.5.2 which in context refer to sections of the Florida Building Code, Building Volume. The petition requested a variance or waiver exempting the school from certain toilet and sanitary facilities requirements prescribed therein. The petitioner is Moore Haven Christian Academy, located in Moore Haven, Florida.
Notice of the petition was published in Vol. 49, No. 151, F.A.R., on August 4, 2023. Having received no public comment on the petition, an Order of Denial was executed on September 15, 2023. Specifically, the Department’s Order of Denial finds that the Petition fails to seek relief from a rule of the Department, but rather a rule adopted by the Florida Building Commission. As a result the Department is unable to grant a waiver or variance in this matter.
