PURPOSE AND EFFECT: The proposed rule amendment updates the rule language regarding eligibility requirements for licensure.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board concluded that this rule change will not have any impact on licensees and their businesses or the businesses that employ them. The rule will not increase any fees, business costs, personnel costs, will not decrease profit opportunities, and will not require any specialized knowledge to comply. This change will not increase any direct or indirect regulatory costs. Hence, the Board determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

64B10-11.001 Application for Licensure.
Any person desiring to be licensed as a nursing home administrator shall apply to the Board of Nursing Home Administrators. Application fees, pursuant to Rule 64B10-12.0001 64B10-12.001, F.A.C., shall apply.
(1) For licensure by examination, an applicant shall submit the application shall be made on the Application for Nursing Home Administrators by Examination, form DH-MQA-NHA002, (06/20), hereby adopted and incorporated by reference, which can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref-12185, or from the Board of Nursing Home Administrators, 4052 Bald Cypress Way, Bin #C-07, Tallahassee, FL 32399-3257, http://floridasnursinghomeadmin.gov/resources. the Board’s website at http://floridasnursinghomeadmin.gov/applications/application-licensure-examination-nha.pdf. Licensure eligibility requirements are listed in subsection 64B10-11.002(2), F.A.C.
(2) For licensure by endorsement, an applicant shall submit the application shall be made on the Application for Mobile Opportunity by Interstate Licensure Endorsement (MOBILE) Nursing Home Administrators by Endorsement, form DH-MQA-5101, (7/2024) NHA5936, (6/2020), hereby adopted and incorporated by reference, which can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref- 12186, or from the Board of Nursing Home Administrators, 4052 Bald Cypress Way, Bin #C-07, Tallahassee, FL 32399-3257, http://floridasnursinghomeadmin.gov/resources. Board’s website at http://floridanursinghomeadmin.gov/applications/application-licensure-endorsement-nha.pdf. Applicants for licensure shall comply with Section 456.0145(2), F.S., the requirements for which are also referenced in partLicensure eligibility requirements are listed in subsection 64B10-11.002(3), F.A.C.

64B10-11.002 Eligibility Requirements for Licensure.
(1) through (2) No Change.
(3) Licensure by Endorsement. To establish eligibility for licensure as a nursing home administrator by endorsement pursuant to under Section 456.0145(2)468.1705, F.S., the applicant must comply with all applicable statutory requirements listed therein including but not limited to the following:
(a) Successfully passing pass the required examinations in subsection (1) of this rule; and,
(b) Having actively practiced the profession for which the applicant is applying for at least 3 years during the 4-year period immediately preceding the date of submission of the application Have worked as a fully licensed nursing home administrator for 2 years within the 5-year period immediately preceding the application for licensure by endorsement; and,
(c) Submitting a completed application referenced in subsection 64B10-11.001(2), F.A.C.
(c)1. Hold a valid active license to practice nursing home administration in another state, or
2. Meet the qualifications for licensure contained in Section 468.1695, F.S.
