NOTICE OF CHANGE

Notice is hereby given that the following changes have been made to the proposed rule in accordance with Section 120.54(3)(d)1., F.S., published in Vol. 42, No. 246, December 21, 2016, issue of the Florida Administrative Register.

The changes are in response to written comments submitted by the staff of the Joint Administrative Procedures Committee. The rule shall now read as follows:

 

40A-44.091 Processing of Permits.

(1) No change.

(2) General surface water management permits for projects other than impoundments constructed in waters in the State shall be processed in accordance with all applicable provisions of Chapter 40A-1, F.A.C., and shall may be issued by the Executive Director or Executive Director’s his designee after the submitted application is determined to be complete and meets the requirements of this chapter.

(3) No change.

40A-44.351 Transfer of Permits.

(1) through (2) No change.

(3) Requests for transfer of permit shall be made on Form No. A44-D, Request for and Acceptance of Transfer of Permit Issued, effective 7-1-92, amended          , which is hereby incorporated by reference, copies of which can be obtained by contacting the District or online at http://www.flrules.org/Gateway/reference.asp?No=Ref-07884 or the District’s website www.nwfwater.com.

The following changes have been made to incorporated Form No. A44-D:

The “Request for Transfer of Permit Issued” section was removed.

The word “granting” was removed from the form, and the word “issuance” was added in place of “granting”.

The amended date of the form in the footer of Form A44-D has been added.
