PURPOSE AND EFFECT: The amendments proposed will update Rule 5L-3.004, F.A.C., to reflect statutory changes related to mechanical harvesting, will include construction restrictions adjacent to military installations, and will clarify health requirements and other sections.
SUMMARY: The amendments proposed are to reflect statutory changes related to mechanical harvesting, will include construction restrictions adjacent to military installations, and will clarify health requirements and other sections. The industry and division staff, along with other government agencies, have identified changes and language that needs clarification in the Best Management Practices Manual.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department’s economic analysis of the adverse impact or potential regulatory costs of the proposed rule did not exceed any of the criteria established in Section 120.541(2)(a), Florida Statutes. The Department is not proposing amendments to the rule that increase the financial burden to comply with Aquaculture Best Management Practices so there are no additional costs to impact the industry.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
