    PURPOSE AND EFFECT: These rules are being promulgated to provide for fares and rules of conduct on the SunRail intercity passenger rail system.

    SUMMARY: The rule incorporates the SunCard guide, the SunRail fare structure, and the SunRail rules of conduct.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the rule does no impose a regulatory cost. Use of the system is at the passenger's option.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    14-119.001 Definitions.

    (1) “Department” means the Florida Department of Transportation.

    (2) “SunRail” means the commuter rail service operated along the Central Florida Rail Corridor (CFRC) with stations to be located in Volusia, Seminole, Orange, and Osceola counties.

    (3) “Passenger” means any individual entering a Department facility or traveling on a SunRail system train.

    14-119.002 SunRail Cards.

    All passengers who travel on the SunRail system are required to have their own SunCard to enter/exit the system. Children 6 and under ride free when accompanied by a fare paying adult with a 3-child limit, or the child must pay a discount fare.     14-119.003 SunRail Fares.

    14-119.004 Code of Conduct.

    All passengers must comply with the SunRail Rules of conduct https://www.flrules.org/Gateway/reference.asp?No=Ref-03900, incorporated herein by reference. The rules of conduct apply on board SunRail trains and within Department facilities and stations.
