The certification hearing originally scheduled for January 9-12, 2007, has been continued by the Administrative Law Judge pursuant to a Motion for Continuance, and has been rescheduled for March 15, 2007. Administrative Law Judge J. Lawrence Johnston will conduct a hearing to consider the environmental effects and any other appropriate matters regarding whether to approve the site certification of the proposed Seminole Generating Station Unit 3 application for site certification, application number PA 78-10A2, DOAH Case number 06-0929EPP, DEP Office of General Counsel Case Number 06-0780, pursuant to the Florida Electrical Power Plant Siting Act, Sections 403.501-403.518, Florida Statutes. Judge Johnston will prepare a Recommended Order for submission to and final action by the Governor and Cabinet acting as the Siting Board, based on the hearings. Pursuant to Section 403.508(6), Florida Statutes, the certification hearing may ultimately be cancelled if all parties to the proceeding stipulate that there are no disputed issues of fact or law to be raised at the certification hearing, and if the Department and the applicant publish notice of the cancellation of the certification hearing at least 3 days prior to the originally scheduled hearing date. If the certification hearing is cancelled, the Department of Environmental Protection will issue the final order on certification within 40 days of the Administrative Law Judge's order cancelling the certification hearing.
