Purpose


The chapter authorizes 36 categories of activities that can qualify for an environmental resource noticed general permit under Part IV of Chapter 373, F.S. Similar noticed general permits have been issued by the water management districts in Chapters 40B-400, 40C-400, 40D-400 and 40E-400, F.A.C. Chapter 62-341, F.A.C., was last amended by the Department to expand the availability of these general permits to Phase 1 of the new environmental resource permit program within the geographic territory of the Northwest Florida Water Management District (NWFWMD), in accordance with Section 373.4145(1)(a), F.S. Those amendments became effective on October 1, 2007. In accordance with Section 373.4145(1)(b), F.S., the Department is commencing development of the Phase 2 environmental resource permit program within the geographic territory of the NWFWMD. The Phase 2 rules primarily will involve amendments to Chapter 62-346, F.A.C., to regulate the management and storage of surface waters, including isolated wetlands in that area. As part of that rulemaking, the Department may propose amendments to the existing noticed general permits in Chapter 62-341, F.A.C., and may propose new noticed general permits. Because this chapter has statewide applicability, the Department expects to have public workshops around the state if any amendments are proposed to this chapter.
