This is the Final Public Hearing on the adoption of proposed rules 69V-40.002, 69V-40.031, 69V-.051, 69V-40.100, 69V-40.200, 69V-40.220, Florida Administrative Code, published on September 26, 2008, in Volume 34, Number 39, of the Florida Administrative Weekly. No changes have been made to the proposed rules. The rules are being amended to increase fingerprint processing fees from $42.25 to $43.25. The current fee of $42.25 represents $23 charged by the Florida Department of Law Enforcement for a state criminal history check and $19.25 charged by the U.S. Department of Justice for a national criminal history check. During the 2008 regular session, the Florida Legislature passed Senate Bill 1792. This bill was signed into law (Chapter 2008-112, Laws of Florida) by Governor Crist on June 10, 2008. Effective July 1, 2008, the Florida Department of Law Enforcement will be increasing its fingerprint processing fee to $24 as required by Section 1 of Chapter 2008-112, Laws of Florida, which amends Section 943.053(3)(b), Florida Statutes. Also during the regular 2008 legislative session, the Florida Legislature passed House Bill 5049, which amended Section 494.0033, F.S., to reduce the mortgage broker license application fee from $200 to $195. This bill was signed into law (Chapter 2008-135, Laws of Florida) by Governor Crist. Form OFR-494-03, Application for Licensure as a Mortgage Broker, which is incorporated by reference in Rule 69V-40.002, F.A.C., is amended to reflect the reduction in the license application fee.
