Subject
The Chapter sets forth the rules and procedures for coastal construction and excavation applicable to permits for construction seaward of the Coastal Construction Control Line and Fifty-Foot Setback. The Department is proposing changes to the definitions of “eligible” and “vulnerable” to clarify that in order to qualify for coastal armoring, the eligible private structure to be protected must be located wholly or partially seaward of the applicable Coastal Construction Control Line, and to clarify the models used by the Department to establish vulnerability. Notice of Rule Development was published in the FAR on October 22, 2019.
