The purpose of this prehearing conference is to: (1) simplify the issues; (2) identify the positions of the parties on the issues; (3) consider the possibility of obtaining admission of fact and of documents which will avoid unnecessary proof; (4) identify exhibits; (5) establish an order of witnesses; and (6) consider such other matters as may aid in the disposition of the action.
HEARING
DATE AND TIME: Monday - Wednesday, April 2, 3, and 4, 2007, at 9:30 AM
PLACE: Room 148, Betty Easley Conference Center, 4075 Esplanade Way, Tallahassee, Florida.
PURPOSE: The purpose of this hearing is for the Commission to take final action on the Office of Public Counsel’s Petition for Order Requiring Progress Energy Florida, Inc. to Refund to Customers $143 million, Representing Past Excessively High Fuel Costs Stemming from Failure to Utilize the Most Economical Sources of Coals for Crystal River Units 4 and 5, and to consider any motions or other matters that may be pending at the time of the hearing. The Commission may rule on any such motions from the bench or may take the matters under advisement.
The hearing will be governed by the provisions of Chapter 120, Florida Statutes; and Chapters 25-22 and 28-106, Florida Administrative Code.
