CANCELLATION OF HEARING: The certification hearing scheduled for March 15, 2007, and noticed on January 19, 2007, has been cancelled. In accordance with the Florida Electrical Power Plant Siting Act, Section 403.527(6), F.S., on February 22, 2007, all parties to this proceeding stipulated that there are no disputed issues on material fact or law to be raised at the certification hearing and requested that the Administrative Law Judge cancel the certification hearing and relinquish jurisdiction to the Department of Environmental Protection pursuant to Section 403.508(6)(a), F.S. On February 23, 2007, Administrative Law Judge J. Lawrence Johnston issued an order granting the request pursuant to Section 403.508(6)(b), F.S. Pursuant to Section 403.509(1), F.S., the Department of Environmental Protection will prepare and issue a Final Order within 40 days of the Judge’s Order.
