The Agency is holding a hearing to consider the Petition for a Declaratory Statement filed by Morton Plant Hospital Association, Inc., d/b/a Morton Plant Hospital, notice of which was published on page 587 of the February 2, 2007, Volume 33, Number 5 edition of the Florida Administrative Weekly. The Petition seeks a declaratory statement from the Agency as to the applicability of Rules 59A-3.066(2)(e), 59A-3.079(3), and 59A-3.081(11), Fla. Admin. Code, to the Petitioner’s intended development of a freestanding emergency department at a location off the premises of Morton Plant Hospital. Additionally, the Petition seeks a declaratory statement from the Agency as to whether the Agency will add the proposed freestanding emergency department to Morton Plant's Class I Hospital license as an offsite outpatient facility upon Morton Plant's satisfaction of applicable statutory and regulatory requirements.
