Pursuant to 40 CFR 51.102, the Department of Environmental Protection (DEP) announces an opportunity to offer comments or request a public hearing on a proposed revision to Florida’s State Implementation Plan (SIP) under the Clean Air Act. On November 22, 2010 (effective December 31, 2010), the Environmental Protection Agency (EPA) designated a small area (1.5 kilometer radius circle) in Hillsborough County nonattainment for lead (Pb). This nonattainment area is centered on a lead recycling facility that received a federally enforceable air construction permit in 2009, which provides for a complete modernization of the facility and the implementation of a variety of top level controls and emission limits associated with lead recycling. DEP is proposing that the air construction permit be incorporated into Florida’s SIP in satisfaction of Clean Air Act requirements for attainment and maintenance of the revised lead (Pb) National Ambient Air Quality Standard in the Hillsborough County nonattainment area. A public hearing will be held, if requested, at the date, time and place given above. It is not necessary that the hearing be held or attended in order for persons to comment on DEP’s proposed submittal to EPA.
