The purpose and effect is to create new Rule 69U-100.323, Florida Administrative Code, and to create and incorporate Form OFR-U-323 to conform with and implement Ch. 2023-28, Laws of Florida, signed into law on May 2, 2022. The legislation requires each financial institution subject to the financial institutions codes to attest, under penalty of perjury, on a form prescribed by the commission, that the entity is acting in compliance with the newly enacted section 655.0323(1) and (2), Florida Statutes.
