To receive testimony and public comment and take final action on adoption of the Fiscal Year (FY) 2010 State Revolving Fund priority list for water pollution control loan projects under Chapter 62-503, Florida Administrative Code (F.A.C.). Projects currently listed on the contingency portion of the FY 2009 priority list will be elevated to the fundable portion of the FY 2010 priority list in rank order, subject to the $10 million segment cap. There are currently no funds available for adding new projects to the fundable portion of the FY 2010 priority list. New construction projects which met program requirements by the June 1, 2009 deadline, and new preconstruction projects, will be ranked and added to the bottom of the FY 2010 contingency portion of the priority list. Pursuant to subsection 62-503.600(4), F.A.C., the Department’s funding commitment to projects currently assigned to the water pollution control loan priority list may be withdrawn at the hearing if a local government is delinquent in submitting documents as scheduled. Prior to Department action at the hearing, all interested persons will have the opportunity to testify regarding the list and any proposed actions. The Department may adopt, modify, or deny the proposed actions at the hearing. After the hearing, the Department will file the written Record of Final Agency Action. A copy of the Record of Final Agency Action will be made available to persons sponsoring the projects at issue and to any person submitting a timely written request.
