Revisions to most of the sections of Chapter 62-344, F.A.C., “Delegation of the Environmental Resource Program to Local Governments,” are required to conform to amendments made to Section 373.441, F.S., in 2010. The substantive changes will provide that the Department is now the sole agency who can delegate, in whole or in part, Environmental Resource Permit (ERP) program responsibilities under Part IV of Chapter 373, F.S., to a county, municipality, or local pollution control program (local governments). Previously the ERP program also could be delegated to a local government by a water management district (WMD). Section 373.441(1), F.S., also requires that Chapter 62-344, F.A.C., include provisions for a local government to petition the Governor and Cabinet for review of a delegation request that is not approved or denied within one year of being initiated. Rule 62-344.900, F.A.C., also is proposed to be repealed to delete an unnecessary form for a local government to use to verify comprehensive plan consistency.
