SUMMARY: This rule is mandated by federal law to ensure that Medicaid-certified nursing facility applicants and residents with mental illness, intellectual disabilities, or related conditions are identified and admitted or allowed to remain in a nursing facility only if there is a verified need for nursing facility services. Additionally, if a need for specialized services is determined, federal guidelines require that such services must be provided.
