In accordance with the Florida Electrical Power Plant Siting Act, Section 403.508(6), F.S., on August 31, 2009, all parties to this proceeding stipulated that there are no disputed issues on material fact or law to be raised at the certification hearing and filed a motion requesting that the Administrative Law Judge cancel the certification hearing and relinquish jurisdiction to the Department of Environmental Protection pursuant to Section 403.508(6)(a), F.S. The following week, the Administrative Law Judge issued an order granting the request pursuant to Section 403.508(6)(b), F.S.
