On September 12, 2013, the District's Governing Board issued SFWMD Order No. 2014-002-DAO-ROW to Craig Ehrnst on behalf of Peninsula corporate center Association (Application No. 13-1030-1). The petition for waiver was received by the District on November 6, 2013. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Weekly, Vol. 39, No. 219, on November 8, 2013. No public comment was received. This Order provides a waiver of the District's criteria to allow an existing culvert connection to remain within the south right of way of the C-15 Canal; Section 31, Township 46 South, Range 43 East; Palm Beach County. Specifically, the Order grants a waiver from Rules 40E-6.221(j), Fla. Admin. Code, and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in Rules 40E-6.091(1), Fla. Admin. Code, which governs the invert elevation of a culvert connection within works or lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver as follows: 1) the existing culvert connection will not interfere with the District's current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.

On December 20, 2013, the Division issued a final order on a petition for variance from Petitioner, Sarasota Kennel Club, Inc., filed October 25, 2013, and advertised in Vol. 39, No. 217, of the Florida Administrative Register – DBPR Case No. 2013044305 (VW 2013-364).
The final order grants Petitioner a variance until April 19, 2014, from the requirements for moveable metal crates when housing greyhounds of subparagraph (2)(e)2.. of Rule 61D-2.023, Florida Administrative Code, because of the temporary lack of availability of replacement crates that meet the rule requirement.
