The proposed rule will amend the Loss Prevention Evaluation Survey Form DFS-D0-860. The purpose of the survey is to promote loss prevention by reducing claim costs and lost productivity for state agencies and universities.
Section 284.50(1), F.S., provides “[t]he Department of Financial Services shall provide appropriate training to the safety coordinators to permit them to effectively perform their duties within their respective departments.” Each year, the Loss Prevention Section of the Division of Risk Management surveys the State’s agencies and universities to learn the details of loss prevention activities within each agency and university. The survey responses assist the Loss Prevention Section in carrying out its mission to provide targeted, appropriate training to the safety coordinators of each state agency and university. The survey has been updated to take advantage of new knowledge in the field to better assist the agencies and universities in promoting loss prevention.

The purposes and effects of the proposed rule development are to establish or revise rule provisions, during calendar year 2011, associated with general methods of taking game, protection of certain deer and turkey, tagging of deer and turkey, possession or sale of birds or mammals, taxidermy operations and mounting requirements, and the use of dogs for taking game.

The purpose of the repeal is to remove a rule from the Florida Administrative Code which no longer has statutory authority. The effect is to streamline the rules in the Florida Administrative Code.

Rule 6A-6.03312, F.A.C., is amended to align the rule with Section 1003.571, Florida Statutes, and the federal regulations at 34 CFR §300.530(e)(1). Rule 6A-6.0333, F.A.C., is amended to align the rule with Sections 39.0016(3)(b) and 1003.571, Florida Statutes, and the federal regulations at 34 CFR §300.519, regarding assignment of a surrogate parent to an eligible student with a disability, and to remove the requirement related to gifted students. Rule 6A-6.0361, F.A.C., is amended to comply with the requirement in Section 1003.57(3)(d), Florida Statutes, that the Department of Education adopt by rule procedures related to residential placement of students with disabilities and to update references, including services to infants and toddlers. The effect of all proposed amendments is to ensure consistency between Florida statute and federal regulations.

The purpose of this rulemaking is to revise the existing rule to allow flatwoods citrus producers outside of the Peace River Manasota Basin Area the opportunity to enroll in approved citrus best management practices.
- Petitions and Dispositions Regarding Rule Variance or Waiver (13)

The Order Denying Waiver was issued in response to a Petition for Waiver filed by William Scotsman, Inc. on September 30, 2010, and advertised in Vol. 36, No. 47, November 24, 2010, edition of the Florida Administrative Weekly. The rule from which a waiver was sought was Rule 9B-1.030, F.A.C. This rule governs responsibility for affixing insignia to existing factory built schools and the conditions therefore. It was assigned the number DCA10-WAI-194. The petition was denied because the relief explicitly requested requires deviation from statutory requirement.

This Order (10-0014) grants variance under Section 120.542, F.S., to Arthur Lee Hane, 15659 N. W. 49th Lane, Cheifland, Florida 32626, for the rebuilt of a home destroyed by fire in the same footprint as previous home, located in Township 12 South, Range 13 East, Section 32, Levy County, for Arthur Hane District Floodway Project (ERP10-0218). The petition for variance was received by SRWMD on October 21, 2010. Notice of receipt of petition requesting variance was published in F.A.W., Vol. 36, No. 44, November 5, 2010. No public comment has been received. This Order provides a variance from SRWMD criteria for subsection 40B-4.3030(9), F.A.C., as to the zero rise certification requirement and paragraph 40B-4.3030(12)(b), F.A.C., as to the 75-foot setback requirements. SRWMD granted the petition because the petitioner has demonstrated that the purpose of the statute underlying the rule will be met and that a substantial hardship would be created if the petitioners were required to comply with this rule.

Daniel Hernandez, Esq., representing Infiltrator Systems, Inc. Specifically, the petitioner seeks a variance from paragraphs 64E-6.013(1)(a), (2)(a), (2)(i), (6)(c), and (10)(d), Florida Administrative Code. These rule provisions allow for tanks to be constructed of concrete, fiberglass or polyethylene; tank stiffening members to be a homogenous integral part of the structure; joints, mid-seams, risers and lids to be sealed using a bonding compound that meets ASTM C 990-96; polyethylene receptacles to meet IATMO PS 1-93, Paragraph 5.4, regarding wall, top, bottom and cover thickness; and tanks with seams below the outlet invert to be watertightness tested per ASTM C 1227-98 after installation in the field.

On November 22, 2010, the Criminal Justice Standards and Training Commission (CJSTC) received a Petition for Waiver of subsection 11B-27.00212(14), F.A.C., from Okeechobee County Sheriff's Office. subsection 11B-27.00212(14), F.A.C., requires officers to requalify with a firearm every two years by completing a course of fire with a passing score as mandated by the rule and administered by a CJSTC certified firearms instructor. The Petition covered the requalification shoots of 29 named officers. The officers had successfully requalified by shooting the correct course of fire and receiving passing scores, however, the three firearms instructors who supervised the shoots were not fully CJSTC certified at the time of the shoots. This request covered the requalifications of these 29 officers for the 2008 and 2010 requalification deadlines. The CJSTC published notice of this Petition in the Florida Administrative Weekly Vol. 36, No. 49, December 10, 2010.
On December 16, 2010, at a publicly noticed business agenda meeting held via teleconference, the Commission found that the Petitioner’s situation is unique. The Petitioner demonstrated that the strict application of the Commission’s rules in this case would violate the principles of fairness resulting in the need to for the Petitioner to requalify 29 officers who would be separated automatically by the CJSTC from 2008 to the time the officers requalified yet again, even though the officers had completed the requirements of the rule by shooting the correct course of fire both in 2008 and 2010. This separation of otherwise fully qualified officers would be mandated by the rule simply because the three instructors supervising the shoots were not fully CJSTC certified at the time of the shoots. The Commission found that the purposes of the underlying statute, to ensure that officers are properly trained, will be met by granting this waiver request. The Commission granted the Petitioner a permanent waiver of the rule for the 29 officers for the 2008 and 2010 firearms requalification reporting cycles.

Waiver of paragraph 9B-43.006(3)(b), F.A.C. It was assigned the number DCA10-WAI-116. The rule (which no longer exists) provided penalty points for failure to create jobs under the Florida Small Cities Community Development Block Grant program. Soon after submission, Petitioner verbally notified the Department of its intent to withdraw the petition pursuant to Rule 28-104.002, F.A.C. On June 15, 2010, Petitioner submitted a written withdrawal letter which was deemed legally insufficient. On December 21, 2010, Petitioner submitted a legally sufficient withdrawal letter.

The Department of Business and Profesional Regulaion, Division of Hotels and Restaurants has issued an order. The Department received a Petition for a Routine Variance on November 15, 2010 for Paragraph 4-301.12(A), 2001 FDA Food Code and subsection 61C-4.010(5), Florida Administrative Code from Subway @ Lee Memorial Hospital located in Fort Myers. The above referenced F.A.C. addresses the requirements the requirement that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided. They are requesting to share the three-compartment sink located within Lee Memorial Hospital kitchen.
The initial petition was published in Vol. 36/48 on 12/03/10. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the dishwashing facility (including handwash sink) located within Lee Memorial Hospital Main Kitchen are maintained in a clean and sanitary manner and provided with hot and cold running water under pressure and are available during all hours of operation. If the hours of operation or ownership of Lee Memorial Hospital Main Kitchen changes, an updated signed agreement for use of the dishwashing facility is required immediately.

The Florida Department of Business and Professional Regulation, Division of Hotels and Restaurants has issued an order. The Department received a Petition for an Emergency Variance on November 10, 2010 for paragraph 61C-1.004(2)(a), Florida Administrative Code, subsection 61C-4.010(7), Florida Administrative Code, subsection 61C-4.010(6), Florida Administrative Code, and Section 6-402.11, 2001 FDA Food Code from China Broadway located in West Palm Beach. The above referenced F.A.C. addresses the requirements the requirement that at least one accessible bathroom be provided for use by customers and employees. They are requesting to share bathroom facilities with an adjacent laundry establishment under the same ownership.
The Petition was published in Vol. 36/48 on December 3, 2010 and after a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within the La Raca Coin Laundry are maintained in a clean and sanitary manner and are provided with hot and cold running water under pressure, soap, approved hand drying devices, and available during all hours of operation. The Petitioner shall also ensure directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of La Raca Coin Laundry changes, a signed agreement for use of the bathroom facilities is required immediately.

This is a meeting of the Marine Numeric Nutrient Criteria Technical Advisory Committee (MTAC). This is a follow up to meetings held on September 29, 2010 (Tallahassee) and November 17, 2010 (Ft. The purpose of the public hearing is to share project information and seek comments in a formal setting (public hearing) for the proposed Environmental Assessment for the Bus Rapid Transit (BRT) North Corridor project. The public hearing is being conducted to give all interested persons an opportunity to express their views concerning the location, conceptual design and social, economic, and environmental effects of the proposed improvements and in accordance with Federal Executive Orders 11990 and 11988. The proposed improvements involve a 9.28-mile alignment on existing surface streets and predominantly within existing right of way. The proposed alignment extends north from Broad Street and State Street in downtown Jacksonville along Boulevard Street to Golfair Boulevard, and then extends west along Golfair Boulevard and north along Brentwood and Norwood Avenues to Lem Turner Road, ending approximately at Armsdale Road (south of I-295). These improvements will allow JTA to provide improved service, minimize costs and improve transit operations.
Anyone attending the public hearing may submit comments orally or in writing at any time during the open house or after the formal presentation. Persons wishing to speak during the formal comment period will obtain a speaker card at the meeting. A stenographer will document all oral comments.

Regular scheduled meeting of the Governor and Cabinet
The State Board of Administration will take action on matters duly presented on its agenda, which may include such matters as Executive Director’s reports; approval of fiscal sufficiency of state bond issues; approval of sale of local bonds at an interest rate in excess of statutory interest rate limitation; report on investment performance; designation of banks as depositories for state funds; adoption of rules and regulations; investment of state funds pursuant to Chapter 215, F.S.; and consideration of other matters within its authority pursuant to Chapters 215 and 344, F.S., and Section 16 of Article IX of the Florida Constitution of 1885, as continued by subsection 9(c) of Article XII of the Florida Constitution of 1968. The Division of Bond Finance of the State Board of Administration will take action on matters duly presented on its agenda, which will deal with the issuance of State bonds, arbitrage compliance and related matters.
The Financial Services Commission will take action on matters duly presented on its agenda which may include, but not be limited to, matters relating to rulemaking for all activities concerning insurers and other risk bearing entities, including licensing, rates, policy forms, market conduct, claims, adjusters, issuance of certificates of authority, solvency, viatical settlements, premium financing, and administrative supervision, as provided under the Insurance Code or Chapter 636, F.S., and for all activities relating to the regulation of banks, credit unions, other financial institutions, finance companies, and the securities industry.
The Department of Veterans’ Affairs will take action on matters duly presented on its agenda which may include the administration of the Department as well as actions taken to further the Department’s mission of providing assistance to veterans and their dependents, pursuant to Section 292.05, F.S.
The Department of Highway Safety and Motor Vehicles will take action on matters duly presented on its agenda, which may include such matters as approval of agency policies, taking agency action with regard to administrative procedure matters, and considering other matters within its authority pursuant to Florida Statutes.
The Department of Law Enforcement will take action on matters duly presented on its agenda which may include but not be limited to such matters as transfer of agency funds or positions, formulation of Departmental Rules, administrative procedure matters, submittal of reports as required, enter into contracts as authorized and to consider other matters within its authority pursuant to Chapters 20, 23, 120 and 943, F.S.

The Department of Education will finalize agency action on the business of the Florida Department of Education.
The Administration Commission will take action on matters duly presented on its agenda which may include such matters as to create or transfer agency funds or positions, approve Career Service rules, administrative procedure matters, environmental matters arising under Chapter 380, F.S., comprehensive planning issues pursuant to Section 163.3184, F.S., determine sheriffs’ budget matters, and consider other matters within its authority pursuant to Chapters 110, 215 and 216, F.S.
The Florida Land and Water Adjudicatory Commission will take action on matters duly presented on its agenda including appeals of local government development orders in areas of critical state concern or of developments of regional impact under Section 380.07, F.S.; and review of water management matters under Chapter 373, F.S. The Commission will also review Department of Environmental Protection’s rules and orders which, prior to July 1, 1993, the Governor and Cabinet, sitting as the head of the Department of Natural Resources, had authority to issue or promulgate.
The Board of Trustees of the Internal Improvement Trust Fund will take action on matters duly presented on its agenda which may include such matters as mineral leases or sales, state or sovereign land leases, sales, exchanges, dedications, and easements, Conservation and Recreation Lands (CARL) and other land purchases; land planning matters and other matters within its authority. Additionally, the Board will take action on matters presented by the Marine Fisheries Commission as set forth in Sections 370.025, 370.026 and 370.027, F.S., and matters pertaining to the Office of Greenways Management, the Office responsible for the management of lands which formerly fell within the Cross Florida Barge Canal project corridor.
The Department of Environmental Protection, while not a Cabinet agency, will present for consideration on its agenda those matters required by law to be reviewed by the Governor and Cabinet and those pertaining to the siting of power plants, electric and natural gas transmission lines and hazardous waste facilities; coastal zone management consistency and standards adopted by the Environmental Regulation Commission.
