To amend the processing fees in Rule 62-4.050, F.A.C., for environmental resource permit (ERP) activities regulated under Part IV of Chapter 373, F.S. These amendments are associated with adoption of the “Statewide Environmental Resource Permit” (ERP) rule, Chapter 62-330, F.A.C., authorized by Section 373.4131, F.S. The processing fees apply statewide when the Department is responsible for the review and agency action on an ERP activity; separate rulemaking to amend processing fees will be, or has been, noticed by the water management districts when they are responsible for the review and agency action on an ERP activity in accordance with the Operating Agreements incorporated by reference between the agencies in Chapters 62-113 and 62-346, F.A.C.

The Board proposes the rule amendment to modify the rate the Department assesses the gross amounts of pilotage earned.

The purpose of the rule development is to review the rule for needed updates to the student progress monitoring requirement for elementary students to be consistent with governing law. In addition, references to FCAT will be updated to reference FCAT 2.0 and two courses for college success/preparation will be reviewed for possible inclusion in the list for reading intervention for high school students.

The Agency for Persons with Disabilities received a Petition for Variance from Rule 65G-2.012(8)(c)1, F.A.C. from Our Place Group Home, Inc. located at 415 Harbor Blvd. in Port Charlotte. Rule 65G-2.012(8)(c)1 states that bedrooms shall be arranged so that privacy is assured for clients. Sole access to these rooms shall not be through a kitchen, bathroom or other bedrooms. A maximum of four residents shall share a bedroom used by clients. Our Place sought variance from the rule for one specific bedroom in its group home . The interior access to this bedroom is off a hallway that adjoins the kitchen, pantry and the laundry room. This bedroom has doors close to this hallway and the room itself has another door that opens to the exterior of the building.
Petition for Variance has been granted. This variance is limited to the facts and circumstances of this specific room in this specific group home as it is configured on this date and and as of this time.

of the issuance of an Order regarding the Petition for Variance or Waiver for Denese Gail Simone Marshall, Psy.D., filed on August 3, 2012. The Notice of Petition for Variance and Waiver was published in Volume 38, No. 34, of the August 24, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on October 5, 2012. The Petitioner was seeking a permanent variance or waiver of Rule 64B19-11.005, Florida Administrative Code, with regards to the requirement that all applicants for licensure complete at least 2,000 hours of post doctoral experience under a supervisor whose supervision comports with this rule.
The Board's Order, filed on November 14, 2012, grants the Petition for Variance or Waiver. The Petitioner has demonstrated that the Petition for Variance and Waiver was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has demonstrated that she meets the purpose of the underlying statute. Further, Petitioner has demonstrated that application of the rule would cause a substantial hardship and would violate the principles of fairness. Further, the Board certifies that the Petitioner has satisfied all requirements for licensure as a psychologist in the State of Florida.

Variance or Waiver, filed on October 29, 2012, by Aditya Ayithi. The Petitioner seeks the Variance or Waiver from Rule 61G15-20.007, F.A.C., with respect to the requirement that each applicant for a Florida engineers license must demonstrate the completion of 32 college semester credit hours or higher mathematics and basic sciences.
The Board will address this Petition at its next meeting.

Consideration of Applicant’s Handbook, Volume II, specific to Northwest Florida Water Management District, which is incorporated by reference in Chapter 62-330, F.A.C., “Environmental Resource Permitting.” There have been five workshops pertaining to the Statewide ERP rule, including preliminary discussion on the handbook and processing fees. Each water management district will conduct separate workshops for its specific Applicant’s Handbook, Volume II. This workshop is in conjunction with the workshop to discuss amended fees for the Environmental Resource Permit program in Rule 62-4.050, F.A.C., published in a Notice of Rule Development this same date.; January 30, 2013, 10:00 AM (EST); This workshop will be broadcast via webinar. The City of Gainesville Regional Transit System (RTS) invites you to an open house workshop to learn about the GO Enhance RTS Study and help us shape the future of transit services. The Board considered the Petition at a duly-noticed public meeting held on November 16, 2012. The Petitioner did not state in his request which statute the Petitioner was seeking the Board to interpret. However, Petitioner appeared to be requesting an interpretation of Chapter 489.105, Florida Statutes, and whether a license is required for work on medium, low, and ultralow temperature equipment located in hospitals, laboratories, research facilities, and highly specialized cooling equipment for the U.S. Government.
The Board’s Order, filed on January 3, 2013, issues a Declaratory Statement that a license is not required to service an appliance s described that is designed to be plugged in to an electrical socket when the appliance is not part of the structure.

However, Petitioner appeared to be requesting an interpretation of Chapter 489.105, Florida Statutes, and whether a license is required for technician to investigate the cause and origin of damage to HVAC units and to provide a written report with their findings.
The Board’s Order, filed on January 3, 2013, issues a Declaratory Statement that an air conditioning license is required to perform the services described in the petition.
