Repeal of Rule 69L-26.003, F.A.C.

Rule 69L-6.026, F.A.C., requires employers who are issued stop-work orders, where the assessed penalty exceeds $50,000, to file quarterly compliance reports with the Division of Workers’ Compensation. The Division is now able to efficiently monitor such compliance through the use of their data systems, which renders the filing of such employer reports unnecessary. Likewise, given the elimination of the need to file such reports, the rule, likewise, becomes unnecessary and is repealed.

To present information and receive public comments on proposed revisions to Chapters 62-302, 62-303, and 62-4, F.A.C., under the Triennial Review of state surface water quality standards. This public workshop is a follow up to public workshops held on May 15 – 17, July 31, August 1 – 2, and November 15, 2012, as well as a public meeting of the Human Health-based Criteria Peer Review Committee on October 8 – 9, 2012. Proposed changes include the incorporation by reference (either wholly or in part) of a document titled “Implementation of Florida’s Numeric Nutrient Standards” in Rule 62-302.300, F.A.C., which EPA relied upon for its approval of the Department’s numeric nutrient standards, revisions to human health-based surface water quality criteria, revisions to the dissolved oxygen criteria (both fresh and marine waters), and other issues discussed at the previous public workshops.

Douglas D. Adkins, Executive Director, Dayspring Village; Petitioner sought a determination from the Department regarding the Agency for Health Care Administration's use of Section 429.28, Florida Statutes, as a legal mechanism to cite state-licensed assisted living facilities for issues including, but not limited to, infection control. The Department has denied the Petition for Declaratory Statement because most or all of the questions posed to the Department by Petitioner fail to allege both a particularized set of circumstances as well as the specific statute, rule, or order of the agency claimed to apply to Petitioner's individualized set of circumstances, in contravention of the requirements as specified in Section 120.565, Florida Statutes. When an agency is called upon to issue a declaratory statement in response to a question which is not limited to specific facts and a specific petitioner, and which would require a response of such a general and consistent nature as to meet the definition of a rule, the agency may decline to issue the declaratory statement.
