The purpose of the proposed amendments to Rule 12A-1.097, F.A.C. (Public Use Forms), is to adopt, by reference, 2 forms used by data center owners to apply for Data Center Property exemption certificates.
The purpose of the creation of the proposed Rule 12A-1.108, F.A.C., is to: (1) provide guidance to regarding the exemption for purchases of data center property in Section 212.08(5)(s), F.S., which became effective July 1, 2017, provided by Section 26, Chapter 2017-36, Laws of Florida; and (2) provide exemption requirements, definitions, and application procedures for data center owners, data center tenants, data center contractors, and retailers.

The purpose of the proposed amendment to Rule 12A-16.008, F.A.C., is to adopt, by reference, changes to a form that currently provides guidance to taxpayers that file Solid Waste and Surcharge Returns. Changes to the form brings it into compliance with current administrative procedures and updates contact information for the Department.

The Board proposes the rule amendment to delete unnecessary language and to add new language to update and clarify procedures for demonstrating compliance by licensees.

The purpose of this rulemaking is to adopt revised minimum and guidance levels for Lake Lowery located in Polk County. The effect of the rule is to support the District’s water supply planning, water use permitting, and environmental resource permitting programs.

variance from Randy Hogan, PO Box 429 Old Town, FL 32680, pursuant to Section 120.542, F.S. Petitioner is seeking a variance from paragraph 40B-4.3030(13) F.A.C., as to no construction, additions or reconstruction shall occur in the front 75-feet of an area immediately adjacent to and including the normally recognized bank of a water. Petitioner proposes to construct an RV carport within the front 75 feet of the Suwannee River. This structure would have minimal effect on water displacement as it would be completely open, and covered above the flood stage. The property is located in Township 10 South, Range 14 East, Section 30 of Dixie County. These rules are intended to set forth criteria for development activities within a Works of the District. The petition has been assigned ERP Number WOD-029-209471-4, Hogan RV Carport.

variance from Robert Hawkins, 2878 NE Hwy 340, Branford, FL 32008. Pursuant to Section 120.542, F.S. Petitioner is seeking a variance from paragraph 40B-4.3030(13) F.A.C., as to no construction, additions or reconstruction shall occur in the front 75 feet of an area immediately adjacent to and including the normally recognized bank of water. The applicant is requesting (perpetually) to have one inch of sand above the normal grade of the riverbank to allow wheelchair access for applicant and guests. The project is located in Township 8 South; Range 14 East; Section 16; in Dixie County. These rules are intended to set forth criteria for development activities within a Works of the District. that on November 29, 2017, the Agency for Health Care Administration entered an order disposing of the Petition for Variance from Rule 59C-1.044, F.A.C. and Incorporated Memorandum of Law filed by Variety Children’s Hospital d/b/a Nicklaus Children’s Hospital on September 5, 2017 and advertised in Vol. 43, No. 182, Florida Administrative Register on September 20, 2017. The Petition was assigned Agency Case Number 2017010257. The Agency for Health Care Administration has issued a Final Order denying a variance from Rule 59C-1.044, F.A.C, related to pediatric organ transplantation program requirements for certificate of need. The variance is denied based upon a finding that the Petition failed to demonstrate that the purpose of the underlying statute will be achieved by other means and that application of the rule to Petitioner would create a substantial hardship or violate principles of fairness.

waiver of subsection 65C-13.024(2), Florida Administrative Code, from Destiny Adoption Services and Consulting, Inc., assigned Case No. 17-042W. Per 65C-13.024(2), F.A.C., each parent preparation pre-service training class shall be led by a certified child protection professional according to Section 402.40, F.S., who has a bachelor’s degree or a master’s degree from an accredited college or university, and who has also successfully met any curriculum-specific requirements to train the department approved parent preparation pre-service training curriculum (e.g. curriculum trainer certification). Each parent preparation pre-service training class shall follow the recommendations of the curriculum designer regarding the number and type of facilitators involved in the training process. If the agency is the designer of the curriculum, the number and types of facilitators to be involved in the training process must be clearly defined.

waiver of subsection 65C-13.024(1) and (2), Florida Administrative Code, from My Florida Adoptions, LLC., assigned Case No. 17-043W. Per 65C-13.024(1) parent preparation pre-service training shall meet the requirements of Section 409.175, F.S., and shall include training for out-of-home caregivers on decision-making related to the balance of normalcy for children in care and their safety. The parent preparation pre-service curriculum shall also include training related to the administration of psychotropic medication, the social and emotional development of children and youth, the role of mentors and other helpers, development of life skills for teens in care, and the caregiver’s role in supporting and promoting the educational progress of the child. The training on administration of psychotropic medication shall consist of a review of the proper dosage of medication and the importance of monitoring for possible side effects and intended effects of the specific medications administered to the child. All caregivers are required to complete a minimum of 21 hours of pre-service training. 65C-13.024(2), F.A.C., requires that each parent preparation pre-service training class shall be led by a certified child protection professional according to Section 402.40, F.S., who has a bachelor’s degree or a master’s degree from an accredited college or university, and who has also successfully met any curriculum-specific requirements to train the department approved parent preparation pre-service training curriculum (e.g. curriculum trainer certification). Per 65C-13.030(l)3 the licensed out-of-home caregiver shall not have driving violations less than five years old which relate to driving under the influence of alcohol or drugs on file with the Department of Highway Safety and Motor Vehicles. A copy of the licensed out-of-home caregiver’s driving record shall be provided to the licensing authority at the time of initial licensure and at each re-licensure.

The Sarasota/Manatee Barrier Islands Traffic Study is examining the feasibility of improving the overall infrastructure, including traffic operations and circulation, on the Sarasota/Manatee barrier islands as well as island-to-mainland connections. Phase 1 of the traffic study is complete. Phase 2 of the project is underway and includes observations, collection of traffic data, review of land use, parking studies, etc.

The petition sought a declaratory statement as to whether it is permissible under Chapter 560, Florida Statutes for TCCS to cash a check and load proceeds onto a prepaid debit card provided that the consumer will not bear any cost loading or withdrawing any of these proceeds; and for TCCS to distribute cash for check cashing and deferred presentment transactions, not at the Kiosk in the lobby of grocery store, but rather by sending the customer with a cash voucher or the similar receipt to the grocery store's service desk to have the cash disbursement occur through that more secure environment.
On January 16, 2018, the Florida Office of Financial Regulation issued a Final Order on Petition for Declaratory Statement. The Petition filed by DFC Global Corp is DENIED. The information that was included with the Petition was insufficient for the Office to complete its analysis of Petitioner's business model. Consequently, due to the absence of adequate information, the Office is unable to determine whether the proposed activities are lawful under Chapter 560, Florida Statutes.
