On January 22, 2015 the Division issued an order. The Final Order was in response to a Petition for an emergency Variance from FSC Becker Business, filed January 6, 2015, and advertised on January 13, 2015 in Vol. 41, No. 08, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.20.4, 2.18.5.1, and 2.24.2.1, ASME A17.1b, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires the use of a 9.5 mm steel rope and requirement of a metallic sheave because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2015-003).

A series of public workshops for the Integrated Delivery Schedule (IDS) is being sponsored by the South Florida Ecosystem Restoration Working Group to engage the public. Restoration of the South Florida Ecosystem is being implemented via a combination of federal, state, tribal, and local projects. Public discussions related to the IDS will include construction timelines, interdependencies and benefits related to multiple projects. The final IDS will include only federal projects cost shared with the local sponsors (Central and Southern Florida Projects (C&SF) which includes the Comprehensive Everglades Restoration Plan (CERP), Kissimmee River Restoration, and the Everglades and South Florida (E&SF)/Critical Projects). These major projects have been merged into the IDS that provides an overall strategy and sequence for their planning, design, and construction based on ecosystem needs, benefits, costs, and available funding.
The Working Group is sponsoring public workshops to facilitate public participation in the 2015 update of the IDS. Gregory Yantorno; The Notice of Petition for Declaratory Statement was published in Volume 40, No. 181, of the September 17, 2014, Florida Administrative Register.
Petitioner seeks a declaratory statement regarding his responsibilities as a building code administrator according to Section 468.604, Florida Statutes. Specifically asking the following:
(a) Does section 468.604, Florida Statutes, require that Petitioner as the Building Code Administrator/Building Official have direct supervision over permitting staff; (b) If yes, what does direct supervision mean; (c) May someone who is not under the Petitioner's supervision and is not licensed by the BCIAB be appointed to supervise permitting; (d) If Petitioner as the Building Code Administrator/Building Official no longer directly supervises the permitting process as a result of a permitting jurisdiction's change in organizational structure, could he be found in violation of 468, Florida Statutes; (e) Alternatively could the jurisdiction be found in violation; and (f) Could removing the Petitioner's direct supervision over the permitting process be considered "interference by any person." The Board’s Order, filed on December 24, 2014, denies parts "c", "e" and "f" because Petitioner lacks standing to request the statements sought. As to "a", review of Chapter 468 Part XII reveals no requirement that a Building Code Administrator "directly supervise" permitting staff. Given his fact "b" is moot. As to "d", it is denied because "direct supervision" is not a term utilized in the statutory act under review.
