The purpose of the proposed rule amendment is to revise regulations pertaining to the cost and total number available of Grove Park Wildlife Management Area recreational use permits. The effect of the proposed rule amendment will be to enable the agency to better manage fish and wildlife resources and public use on Wildlife Management Areas (WMAs).

The purpose of the proposed rule amendment is to adjust the minimum caliber restriction for hunting deer with muzzleloading rifles from .40 caliber to .30 caliber, update the regulations for taking crows to conform with federal regulations, and to remove the prohibition on hunting game or crows with a bow equipped with sights or aiming devices with electronic computational capabilities or light projection (laser) features during any archery season. The effect of the proposed rule amendment would be to provide hunters with greater flexibility in methods of taking game and crows with archery equipment and muzzleloading guns.

The purpose of the proposed rule changes is to support the establishment of a deer harvest reporting system. The effect of the proposed rule changes will be to enable the agency to better manage deer populations throughout the state through improved deer herd monitoring, Chronic Wasting Disease (CWD) surveillance, and by promoting compliance with proposed annual bag limits.

The purpose of this rule amendment is to prohibit collection of Marine Life species at the Blue Heron Bridge dive site by modifying the regulations found in 68B-42, Florida Administrative Code (F.A.C.).
The effect of this rule will be to maintain the Blue Heron Bridge as a unique and valuable snorkeling and diving experience for non-consumptive marine stakeholders.

The purpose of this rule amendment is to prohibit the activity of chumming while fishing from beaches and to define the terms “chum” and “beach” in 68B-2, Florida Administrative Code (F.A.C.).
The effect of this rule will be to prohibit chumming while fishing from beaches as part of a larger rule amendment package related to shore-based shark fishing.

The purpose of these rule amendments is to provide further conservation of sharks, address stakeholder concerns related to the shore-based shark fishery, clarify current shark regulations through cleanup of the Sharks and Rays rule chapter, and support recent legislative shark finning penalties updates by modifying the regulations found in 68B-44, Florida Administrative Code (F.A.C.).
The effect of these rules will be to establish a mandatory no-cost, annual shore-based shark fishing (SBSF) permit; prohibit chumming when fishing from beaches; require immediate release of prohibited shark species (when fishing from shore); require prohibited shark species remain in the water (when fishing from shore and vessels); require the possession/use of appropriate cutters (when fishing from shore and vessels); and require the use of non-offset, non-stainless steel circle hooks (when fishing from shore and vessels). These rules will also provide additional clarification for the Commission’s current shark regulations and update rule language related to recent legislative shark finning penalty changes.

of the issuance of an Order regarding the Petition for Waiver or Variance, filed on October 25, 2018, by Albin J. Varoski III. The Notice of Petition for Waiver or Variance was published in Vol. 44, No. 213, of the October 31, 2018, Florida Administrative Register. Petitioner sought a waiver or variance of Rule 61J2-3.009(3), Florida Administrative Code, entitled, “Continuing Education for Active and Inactive Broker and Sales Associate Licensees,” which states that a provider shall issue notice of satisfactory classroom course completion only to a licensee attending a minimum of 90% of each of the classroom hours. The Commission considered the instant Petition at a duly-noticed public meeting, held December 12, 2018, in Orlando, Florida.
The Commission’s Order, filed on January 22, 2019, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute would be met by granting a variance from Rule 61J2-3.009(3), F.A.C. The Board further found that Petitioner failed to establish that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.

Administrative Law Judge Francine M. Ffolkes will conduct a hearing to consider the environmental effects and any other appropriate matters regarding whether to approve the site certification of the proposed Tampa Electric Company, Big Bend Unit 1 Modernization Power Plant Siting Application No. PA 79-12A2, OGC Case No.18-0198, Division of Administrative Hearings Case No. 18-2124EPP pursuant to the Florida Electrical Power Plant Siting Act, Sections 403.501-.518, Florida Statutes (F.S.). Following the hearing, Judge Francine M. Ffolkes will prepare a Recommended Order for submission to and final action by the Governor and Cabinet acting as the Siting Board. Pursuant to Section 403.508(3)(a), F.S., parties to the proceeding shall include the Applicant, the Department of Economic Opportunity, the Florida Fish and Wildlife Conservation Commission, the Southwest Florida Water Management District, the Department of Environmental Protection, the Department of Transportation, Hillsborough County, and Hillsborough County Environmental Protection Commission. Any party listed in Section 403.508(3)(a), F.S., other than the Department of Environmental Protection or the Applicant may waive its right to participate in these proceedings if such party fails to file a notice of its intent to be a party on or before the 90th day prior to the certification hearing. In addition, notwithstanding the provisions of Chapter 120, F.S., upon the filing with the administrative law judge of a notice of intent to be a party no later than 75 days after the application is filed, the following shall also be parties to the proceeding: any agency not listed in Section 403.508(3)(a), F.S., as to matters within its jurisdiction; any domestic nonprofit corporation or association formed, in whole or in part, to promote conservation or natural beauty, to protect the environment, personal health, or other biological values; to preserve historical sites; to promote consumer interests; to represent labor, commercial, or industrial groups; or to promote comprehensive planning or orderly development of the area in which the proposed electrical power plant is to be located. Other parties may include any person, including those persons listed herein who have failed to timely file a notice of intent to be a party, whose substantial interests are affected and being determined by the proceeding and who timely file a motion to intervene pursuant to Chapter 120, F.S., and applicable rules. Intervention pursuant to Section 403.508(3)(e), F.S., may be granted at the discretion of the designated administrative law judge and upon such conditions as he or she may prescribe any time prior to 30 days before the commencement of the certification hearing. Motions to intervene must be filed (received) with Administrative Law Judge Francine M. Ffolkes, Division of Administrative Hearings, The DeSoto Building, 1230 Apalachee Parkway, Tallahassee, Florida 32399-1550, at least 30 days prior to commencement of the certification hearing. Project Description: CFX Poinciana Parkway Extension Project Development and Environment (PD&E) Study
This PD&E study is refining and evaluating the alternatives from the earlier Poinciana Parkway Extension Concept, Feasibility, and Mobility Study.
The project has been broken into phases for further evaluation, with the CFX PD&E Study focusing on the extension to County Road (CR) 532. If the project is subsequently approved, it would move into design for eventual construction. A later phase will provide a connection to I-4, either at State Road 429 or at CR 532.
The overall goals of the Poinciana Parkway Extension are to enhance mobility from CR 532 to Poinciana Parkway; reduce congestion and delays on local roads; expand regional connectivity; provide transportation infrastructure to support planned growth; provide consistency with local plans and policies; and enhance safety.
As a special advisory resource to the Central Florida Expressway Authority (CFX) and the consultant team, the EAG is providing input regarding local needs, concerns and potential physical, natural, social and cultural impacts that is crucial in the evaluation of corridor and alternative alignments.
