On January 28, 2015, the Department issued an Order Granting the Petition for Variance filed by The Safety & Intelligence Institute, on December 23, 2014. Notice of the Petition was published in Volume 40, No. 251, of the December 31, 2014, Florida Administrative Register. Petitioner sought a variance from the requirement in Rule 5N-1.140(1)(b), that a minimum one hour final examination be given at the end of each required security officer training course, with course A’s exam consisting of 100 questions, and course B’s exam consisting of 70 questions. Petitioner requested a permanent variance be granted allowing it to administer examinations at various intervals, with such examinations still subject to Department approval , and consisting of not less than a total two (2) hours and 170 questions. The Department’s Order, filed January 28, 2015, granted Petitioner’s request for Variance as Petitioner demonstrated that it met the underlying statutory requirements through other means, and that application of the rule created a substantial economic hardship.

On January 29, 2015 the Division issued an order. The Final Order was in response to a Petition for a Variance from Home 2, filed January 6, 2015, and advertised on January 13, 2015 in Vol. 41, No. 08, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.20.1, 2.18.5.1, 2.20.4, 2.20.5 and 2.20.9 ASME A17.1b, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires steel ropes of a minimum diameter of 9.5 mm because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2015-004).

a permanent waiver of sub-paragraph 11B-20.0014(3)(a)4., F.A.C. from Kevin A. Angelilli. Petitioner wishes to waive that portion of the rule that states an applicant have successfully completed the Underwater Police Science and Technology course as a student. Petitioner states that he currently possesses and maintains a current Scuba Instructor Certification from a nationally recognized organization that meets the standards of the World Recreational Scuba Training Council (WRTC); a Dive Master Certification; and, is a member of the Professional Association of Diving Instructors (PADI). Petitioner states that he has been an instructor/trainer with PADI since 1999 and a Public Safety Diver from 1994-2013. Petitioner states that he has instructed the Underwater Police Science and Technology course within the last four years and is currently a Public Safety Diving instructor teaching at the Florida Keys Community College.
Petitioner states he meets all requirements of the CJSTC Underwater Police Science and Technology course however, because the rule does not provide for equivalency training he is disadvantaged. Petitioner states that a strict application of the rule creates a substantial hardship and would violate principles of fairness because at the current time, the Underwater Police Science and Technology course is not being taught and he therefore cannot comply with Rule 11B-20.0014(3)(a)4., F.A.C. Petitioner states that the purpose of the underlying statute has been achieved by other means.

This is a public workshop to pull together government agencies and public participation to begin work on the 5-year update of the Loxahatchee River Wild and Scenic River Comprehensive Management Plan. Public discussions on the Update will include background and assessments of the outstandingly remarkable values identified within the wild and scenic corridor and the greater Loxahatchee River Watershed for the period 2010 to 2014.
