On December 12, 2018 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Key Largo Hospitality Group LLC located in Key Largo. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink.
The Petition for this variance was published in Vol. 44/241 on December 13, 2018. The Order for this Petition was signed and approved on January 03, 2019. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring he wastewater holding tank for the handwash sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink is provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

Northeast Connector Expressway Extension (US 192 to SR 50/SR 520)
The Central Florida Expressway Authority (CFX) is conducting a Concept, Feasibility and Mobility Study for the proposed Northeast Connector Expressway Extension. The study is looking at whether the extension of a future Northeast Connector Expressway may be viable and fundable in accordance with CFX policies and procedures.
The meetings will be held in an open house format on Tuesday, January 22, from 5:30 p.m. until 7:30 p.m. at the Wedgefield K8 gymnasium, 3835 Bancroft Blvd., Orlando, Florida 32833 and on Thursday, January 24, from 5:30 p.m. until 7:30 p.m. at the Harmony High School cafeteria, 3601 Arthur J. Gallagher Blvd., St. Cloud, Florida 34771. Attendees will be able to come at any point during the meetings to view the study exhibits, ask questions and provide comments. A looping audiovisual presentation will be available for viewing throughout the meeting.
The goal of the Northeast Connector Expressway Extension is to enhance north-south regional connectivity and mobility by providing connections between existing and future east-west corridors within the study area, including the State Road (SR) 408 East Extension, SR 520, SR 528 (Martin Andersen Beachline Expressway), and US 192 (E. Irlo Bronson Memorial Highway).
The work includes the evaluation and documentation of the physical, natural, social and cultural environments within the corridors and the potential impacts associated with the various mobility alternatives. Public involvement and interagency coordination are an integral part of the assessment process, and multiple opportunities for participation are being provided.
If you have any questions or would like more information about the study, please contact Kathy Putnam, Public Involvement Coordinator, by phone at 407-802-3210, or by email at ConceptStudy@CFXWay.com or visit the study webpage at https://bit.ly/2PAsOwJ. Grapefruit Trading, LLC; On 10/9/2018, the Florida Office of Financial Regulation (Consumer Finance) received a Petition for Declaratory Statement from Grapefruit Trading. The petition sought a declaratory statement from the Office on whether its proposed business model (to trade virtual currencies with individuals and corporations in the state of Florida and elsewhere. To conduct bilateral trades to buy or sell virtual currencies using US dollars or other virtual currencies) falls under the Florida Money Transmitter Statute, Chapter 560, Florida Statutes. ******On 1/4/2019, the Office issued a Final Order on the Petition. The Office determined that under the circumstances described, proposed activities would not require Petitioner to obtain licensure as a money transmitter under Chapter 560, Florida Statutes. Under the circumstances described in the findings of facts, Petitioner's transactions occur directly between Petitioner and a counter-party with no third parties involved. Petitioner has complete control over the transactions and Petitioner does not receive, "currency, monetary value, or payment instruments for the purpose of transmitting the same". Consequently, Petitioner is not acting as a "money transmitter", and licensure for these activities is not required under Chapter 560, Florida Statutes.
