The Department proposes to amend the rule to provide a definition for statutory and rule terms and define or revise the terms. The changes will make the definitions set forth in this rule section applicable to both Chapter 64F, Florida Administrative Code and to Chapter 499, Florida Statutes.

This amendment transfers the Historical Museums Grants-in-Aid Program from the management of the Division of Historical Resources to the Division of Cultural Affairs; it incorporates minor statutory changes to the program that became effective July 1, 2008 (as authorized by Section 265.708, Florida Statutes); and it incorporates recommendations made by the Historical Museums Task Force. In regard to the Cultural Support Grants Program, this amendment deletes the minimum funding amount of $2,500. This amendment also deletes the Indemnity Grant Program (because it was repealed by the 2005 Legislature); this amendment establishes a funding amount for applicants for the Youth and Children’s Museums Program who request over $50,000; and this amendment makes other changes affecting all grant programs of the Division as more fully described in the Summary below.

11B-27.0011(5): Revised to add rule language for recantation, as a defense to any violation involving perjury or false statement in a court proceeding, if the perjury or false statement occurred during the performance of work duties or in the course of an administrative investigation, and if the officer making the statement conceded such statement to be false prior to the employing agency’s final disciplinary determination. The first sentence of the proposed rule language was written for court proceedings only and is a restatement of Section 837.07, F.S. The second sentence of the proposed rule language includes only “moral character violations” during the course of an internal affairs investigation and does not include misdemeanor convictions of perjury.
11B-27.00212(13): Changed the use-of-force mandatory retraining requirement from every two-years to once during an officer’s 4-year mandatory retraining cycle. Revised the Mandatory Retraining Report form CJSTC-74 to reflect the new use-of-force mandatory retraining cycle. Implemented the new statutory requirement for elder abuse training, pursuant to Section 943.17296, F.S., effective July 1, 2008. This training requires the Commission’s basic recruit training programs and mandatory retraining requirements to include identification of and appropriate responses for persons suffering from dementia, and identifying and investigating elder abuse.

This is an addendum to a petition that was noticed on November 21, 2008, Vol. 34, No. 47, Florida Administrative Weekly. Petitioner is additionally seeking a variance from paragraph 40B-4.3020(1)(c), F.A.C., as to the requirements for site plan and paragraph 40B-4.3020(1)(d), F.A.C., as to the requirements for building plan. The property owner constructed an unpermitted structure in Madison County, in Township 1 North, Range 11 East, Section 8. These rules are intended to set forth criteria for development activities within a Work of the District. The Petitioner wishes the Commission to waive that portion of the rule requiring a candidate to take the state officer certification examination within four years of beginning basic recruit training. Petitioner did not take the examination within four years of beginning basic recruit training.

waiver of Rule 11B-27.00212(14), F.A.C., from Alachua County Sheriff’s Office and Steven F. Kane. The rule requires officers to be separated from employment if they do not complete mandatory retraining for firearms by the reporting date. The Petitioner failed to timely complete his firearms training because of an on-duty injury. Petitioner completed his firearms qualification after his reporting date and was returned to active duty. He wishes to have the “break-in-service” removed from his records.

variance from Rule 64J-1.003, Florida Administrative Code, from DeSoto County Fire and Rescue.
Nature of Rule: subsection 64J-1.003(4), F.A.C., requires each ALS permitted vehicle when available for call, to be equipped and maintained as approved by the medical director of the service in the vehicle minimum equipment list. The vehicle minimum equipment list shall include, at a minimum, one each of the items listed in Tables I and II. Table II, Ground Vehicle, ALS Equipment and Medications, Equipment, paragraph (v) requires electronic waveform capnography capable of real-time monitoring and printing record of the intubated patient (effective 1/1/2009).
Petitioner has had a purchase order in to Physio Control to install the waveform capnography since October 12, 2007. Physio Control has been under an injunction by the FDA that has prevented them from installing the upgrade. Petitioner is awaiting the FDA clearance and is requesting temporary variance from this rule requirement until December 22, 2009.
All comments and requests for copies of the petitions must be received in writing by January 23, 2009.

The City of Marathon has asked that issues involving the priority score be resolved for their project WW120637060. New projects for loans or loan increases may be added to the fundable or contingency portions of the FY 2009 priority list if the Federal Economic Recovery funds become available.
Eligible grant amounts may be adjusted for projects already listed on the FY 2006 Financially Disadvantaged Small Community Grants priority list which remain incompletely funded.
Prior to Department action at the hearing, all interested persons will have the opportunity to testify regarding the lists and any proposed actions. The Department may adopt, modify, or deny the proposed actions at the hearing.
After the hearing, the Department will file the written Record of Final Agency Action. A copy of the Record of Final Agency Action will be made available to persons sponsoring the projects at issue and to any person submitting a timely written request. This is the Final Public Hearing on the adoption of proposed Rules 69V-40.025, 69V-40.031, 69V-40.100, 69V-40.200, 69V-40.220, and 69V-40.242, Florida Administrative Code, published on November 7, 2008, in Vol. 34, No. 45 issue of the Florida Administrative Weekly. A Notice of Correction was published on November 21, 2008, in Vol. 34, No. 47. No changes have been made to the proposed rules. The rules address the cost of the mortgage broker test. Section 494.0033, F.S., requires the Office of Financial Regulation to make available an electronic version of the mortgage broker test. Persons required to take the mortgage broker test are required to bear the actual cost for the electronic version of the test; however, the fee may not exceed $75. The Office has contracted with a third party to administer the mortgage broker test for $43 per test. Any person required to take the mortgage broker test is responsible for this cost. The State Board of Administration will take action on matters duly presented on its agenda, which may include such matters as Executive Director’s reports; approval of fiscal sufficiency of state bond issues; approval of sale of local bonds at an interest rate in excess of statutory interest rate limitation; report on investment performance; designation of banks as depositories for state funds; adoption of rules and regulations; investment of state funds pursuant to Chapter 215, F.S.; and consideration of other matters within its authority pursuant to Chapters 215 and 344, F.S., and Section 16 of Article IX of the Florida Constitution of 1885, as continued by subsection 9(c) of Article XII of the Florida Constitution of 1968. The Division of Bond Finance of the State Board of Administration will take action on matters duly presented on its agenda, which will deal with the issuance of State bonds, arbitrage compliance and related matters.
The Financial Services Commission will take action on matters duly presented on its agenda which may include, but not be limited to, matters relating to rulemaking for all activities concerning insurers and other risk bearing entities, including licensing, rates, policy forms, market conduct, claims, adjusters, issuance of certificates of authority, solvency, viatical settlements, premium financing, and administrative supervision, as provided under the Insurance Code or Chapter 636, F.S., and for all activities relating to the regulation of banks, credit unions, other financial institutions, finance companies, and the securities industry.

The Department of Law Enforcement will take action on matters duly presented on its agenda which may include but not be limited to such matters as transfer of agency funds or positions, formulation of Departmental Rules, administrative procedure matters, submittal of reports as required, enter into contracts as authorized and to consider other matters within its authority pursuant to Chapters 20, 23, 120 and 943, F.S.

The Department of Education will finalize agency action on the business of the Florida Department of Education.
The Administration Commission will take action on matters duly presented on its agenda which may include such matters as to create or transfer agency funds or positions, approve Career Service rules, administrative procedure matters, environmental matters arising under Chapter 380, F.S., comprehensive planning issues pursuant to Section 163.3184, F.S., determine sheriffs’ budget matters, and consider other matters within its authority pursuant to Chapters 110, 215 and 216, F.S.
The Florida Land and Water Adjudicatory Commission will take action on matters duly presented on its agenda including appeals of local government development orders in areas of critical state concern or of developments of regional impact under Section 380.07, F.S.; and review of water management matters under Chapter 373, F.S. The Commission will also review Department of Environmental Protection’s rules and orders which, prior to July 1, 1993, the Governor and Cabinet, sitting as the head of the Department of Natural Resources, had authority to issue or promulgate.
The Board of Trustees of the Internal Improvement Trust Fund will take action on matters duly presented on its agenda which may include such matters as mineral leases or sales, state or sovereign land leases, sales, exchanges, dedications, and easements, Conservation and Recreation Lands (CARL) and other land purchases; land planning matters and other matters within its authority. Additionally, the Board will take action on matters presented by the Marine Fisheries Commission as set forth in Sections 370.025, 370.026 and 370.027, F.S., and matters pertaining to the Office of Greenways Management, the Office responsible for the management of lands which formerly fell within the Cross Florida Barge Canal project corridor.
