Chapter40A-4, Management and Storage of SurfaceWaters has been incorporated into the new Statewide Environmental Resourse permitting rule 62-330, FAC. therefore the purpose of repealing this rule is to eliminate redundant rules and the effect will only be to eliminate redundancy the same level odf protection will still be required in the design of dams in the Northwest Florida Area

The purpose of these rules is to create a new rule chapter in 68B, Florida Administrative Code (FAC) for blue runner and, in the absence of a federal management plan, assume management authority for the species in federal waters. Currently, there are no specific regulations for blue runner in state waters. However, general statewide regulations such as license requirements and gear restrictions presently apply for blue runner harvest. In addition, F.S. 379.361 defines “commercial quantities” for species that do not have specific bag limits as greater than 100 pounds per person per day. Therefore, the current daily recreational bag limit for blue runner in state waters is 100 pounds. The new rules will establish a statewide recreational bag limit of 100 fish, clarify that there is no commercial bag limit, clarify that an SPL is required to harvest blue runner for commercial purposes, and extend regulations into adjacent federal waters in cases where no federal management plan exists. There is no federal management plan for blue runner in federal waters of the Gulf of Mexico. The South Atlantic Fishery Management Council (SAFMC) recently approved an amendment to remove blue runner from the SAFMC federal snapper-grouper fishery management plan (FMP). The SAFMC approved this amendment, in part, based on the fact that the FWC agreed to manage blue runner harvest in federal waters of the Atlantic. Pending approval of this amendment by the U.S. Secretary of Commerce, blue runner will no longer be managed in any federal waters off Florida. These rules would allow the state of Florida to regulate harvest of blue runner from Gulf federal waters immediately upon implementation of the rule and from Atlantic federal waters upon removal of blue runner from the SAFMC federal FMP
The effect of these rules would be to establish a recreational bag limit in state waters, clarify commercial requirements, and extend the regulations into adjacent federal waters. These rule amendments will also help to prevent the loss of income for commercial fishermen that have historically harvested blue runner from federal waters of the Atlantic as bycatch without a federal snapper grouper permit and allow commercial fishermen to use gears that are currently prohibited under the federal FMP.

The purpose of the proposed rule change is to establish regulations and bag limits for taking ducks, geese and coots in conformance with federal regulations. Rule wording would be changed to increase the bag limit for canvasbacks to two, decrease the bag limit for scaup to two, and increase the possession limit to three times the bag limit for ducks, geese and coots.

The purpose of the proposed rule amendment is to establish regulations and bag limits for taking crows and migratory game birds other than ducks and coots in conformance with federal regulations. Rule wording would be increase possession limits for migratory game birds other than ducks and coots to three times the bag limit.

The proposed improvements include widening to a six-lane, divided roadway and will include bicycle lanes and sidewalks. The design will also include a northbound bridge replacement and a southbound bridge widening over the Melbourne-Tillman Canal.
This meeting is an open house from 5:30 p.m. to 7:00 p.m. Information on the plan to widen Babcock Street (State Road 507) from four lanes to six lanes will be available at the meeting. Representatives from the design team will be available during the meeting to discuss the project and answer questions. FDOT welcomes and appreciates everyone’s participation in the project.

Duke Energy Florida, Inc. (DEF); The Commission granted, in part, and denied, in part, DEF’s Petition for Declaratory Statement. Applying the Commission’s Nuclear Decommissioning Orders and Rule 25-6.04365, F.A.C., Nuclear Decommissioning, the Commission affirmed that funds accumulated in the DEF Nuclear Decommissioning Trust Fund must be allocated among Nuclear Regulatory Commission (NRC) License Termination, Spent Fuel Management, and Site Restoration pursuant to the percentage assigned to each category in the most current Nuclear Decommissioning Study, or update, filed with and relied upon by the Commission pursuant to Rule 25-6.04365, F.A.C. However, the Commission found that the second issue raised by DEF regarding a requirement that DEF obtain prior approval by the Commission for payment of Spent Fuel Management and Site Restoration funds for NRC License Termination Costs was a hypothetical and thus was not proper for a declaratory statement. Final Order No. PSC-13-0452-FOF-EI was issued October 9, 2013, in Docket No. 130207-EI.
