The purpose and effect of these amendments to the District’s rules for the regulation of wells is to incorporate updated versions of related rules adopted by the Department of Environmental Protection (DEP), adopt the new Water Well Construction Disciplinary Guidelines and Citations Dictionary, adopt revised forms for well contractor licensing and license renewal, adopt a revised form for use with well grouting or abandonment, directly incorporate by reference additional materials that are applicable to the regulation of water well construction, and make other minor correcting amendments. The amendments will make the District’s rules consistent with rules recently adopted by the DEP and with recent statutory amendments for the licensing of water well contractors.

- Petitions and Dispositions Regarding Rule Variance or Waiver (12)

On October 07, 2014 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Sweet City Gelato located in Orlando. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash and three-compartment sinks.
The Petition for this variance was published in Vol. 40/196 on October 08, 2014. The Order for this Petition was signed and approved on October 16, 2014. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash and three-compartment sinks is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash and three-compartment sinks are provided with hot and cold running water under pressure; the handwash sink is provided with soap, an approved hand drying device and a handwashing sign.

The Petition seeks a permanent emergency variance and waiver of its administrative rules of 61N-1.023(2) Florida Administrative Code.
Parallon owns and operates 3 prescription drug distribution centers that are licensed by the Department as Restricted Rx Drug Distributors- Health Care Entity. These distribution centers do business under the names West Florida Supply Chain Services, North Florida Supply Chain Services, and East Florida Supply Chain Services. These distribution centers are used to timely distribute prescription drugs to the various facilities under common control and ownership with Parallon; these distribution centers are not Florida-licensed pharmacies.
Parallon requests:
a) A waiver from the limitation in Rule 61N-1.023(2) (a), F.A.C., that prescription drug transfers must be made only to a facility under common control licensed with a pharmacy permit that authorizes the acquisition and possession of prescription drugs; and
(b) A variance permitting Parallon to transfer prescription drugs from the receiving facilities under common control back to Parallon distribution centers, which are not licensed with pharmacy permits.

That the Florida Department of Economic Opportunity has granted a Petition for Waiver of Rule 73C-23.0041(1)(c), F.A.C. on October 28, 2014. The Petition was received from Glades County, Florida and filed with the Department’s agency clerk on September 10, 2014. The Notice of Petition was filed in the Florida Administrative Register on September 17, 2014 and published in Volume 40, Issue Number 181. The Petition sought a waiver from the LMI Population Subgrant Ceiling which determines the maximum amount of funds local governments can apply for in the Florida Small Cities Community Development Block Grant Program. The Petition was granted to enable the County to accomplish economic development activity that it would have not otherwise been able to with the maximum amount of funds available under the LMI Subgrant Ceiling.

This public hearing is being held to give interested persons an opportunity to express their views concerning the location, conceptual design, and social, economic and environmental effects for the proposed reconstruction of the I-95/I-295 northern interchange in Duval County, FL; financial project ID number 213323-1. The project limits are I-95 from just south of SR 104 (Dunn Avenue) to just north of SR 102 (Airport Road) and I-295 from just west of SR 243 (International Airport Boulevard) to just east of Pulaski Road.
The proposed I-95/I-295 interchange reconfiguration includes constructing flyovers, ramps, auxiliary lanes and other minor improvements at interchanges in the system. Also, a noise barrier wall is proposed adjacent to the Biscayne Lake Estates & Cedar North neighborhoods.
As of October 16, 2014, project documents will be available for review at Highlands Branch Library, 1826 Dunn Avenue, Jacksonville, FL 32218 and FDOT Urban Office, 2198 Edison Avenue, Jacksonville, FL 32204.
