  • Petitions and Dispositions Regarding Rule Variance or Waiver (5)
    • Hilton at Rialto. Petitioner seeks an emergency variance of the requirements of an unspecified Section of A17.1, as adopted by 61C-5.001(1), Florida Administrative Code that requires upgrading the elevators which poses a significant economic/financial hardship. Any interested person may file comments within 5 days of the publication of this notice with Mark Boutin, Bureau of Elevator Safety, 1940 North Monroe Street, Tallahassee, Florida 32399-1013 (VW2012-325).
    • On October 4, 2012, the Department issued a Final Order that was in response to a Petition for Variance from Corporate Plaza, filed September 19, 2012, and advertised on October 1, 2012 in Vol. 38, No. 40, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance denies the Petitioner a variance from Chapter 399.035 Florida Statute that requires a handrail inside the cab because this section does not authorize agencies to grant variances or waivers to statues (VW2012-309).
    • On October 4, 2012 the Division issued an order. The Final Order was in response to a Petition for an emergency Variance from South Seminole Medical Plaza, filed September 17, 2012, and advertised on September 28, 2012 in Vol. 38, No. 39, of the Florida Administrative Register (formerly FAW). No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 3.11.3 ASME A17.3, 1996 edition, as adopted by Rule 61C-5.001(1) Florida Administrative Code that requires upgrading the elevators for firefighters’ emergency operations until July 31, 2015 because the Petitioner has demonstrated that the purpose of the statute underlying the rule will be met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2012-302).
    • On October 1, 2012, the Executive Director issued Order No. SWF 12-012, granting a waiver. The District received a petition from Arthur E. Staggs on August 17, 2012, for waiver of rules governing the renewal of water use permits, including Rules 40D-1.603 and 40D-2.361, F.A.C., and the relevant portions of the District’s Water Use Permit Basis of Review (BOR). In the alternative, Mr. Staggs sought waiver of Rules 40D-1.602 and 40D-2.041, F.A.C., and the relevant portions of the BOR governing when water use permits are required. The District published notice of the petition in the Florida Administrative Weekly, Vol. 38, No. 36, dated September 7, 2012. The Order grants the petition for waiver of Rules 40D-1.603 and 40D-2.361, F.A.C., and the relevant sections of the BOR. Mr. Staggs demonstrated that application of the rules would create substantial hardship by causing him to cease agricultural operations on the subject property until the District took agency action on a water use permit renewal application that had been filed by Mr. Staggs on June 8, 2012. The underlying purpose of Section 373.239, F.S., will be achieved as the District is treating the Petitioner’s application for the renewal in the same manner as the initial permit application.
