On November 10, 2014, the Florida Department of Environmental Protection issued an order granting a petition filed by Orange County Environmental, L.L.C. on October 8, 2014, seeking a variance or waiver under Section 120.542, Florida Statutes, for its construction and demolition debris disposal and recycling facility located at 7902 Avalon Road, Winter Garden, Florida. The Petitioner requested a waiver from Rules 62-701.630(3)(a) and 62-7.1.630(3)(b), Florida Administrative Code, which require the owner or operator of a solid waste disposal facility provide closing cost estimates for financial assurance that are based upon a third party performing the work and require the owner or operator include the costs of cover soils rather than allowing the use of on-site soils. The Order, OGC Number 14-0562, granted the waiver of Rules 62-701.630(3)(a) and 62-7.1.630(3)(b) based on a showing that the Petitioner demonstrated that a strict application of the rules would result in substantial hardship and that the purpose of the underlying statute will be or has been achieved by other means. Notice of receipt of the petition was published in the Florida Administrative Register on October 10, 2014. No comments were received.

On November 6, 2014, pursuant to notice, at a meeting held in Kissimmee, Florida the Commission considered a petition for a 180 day temporary waiver of Rule 11B-27.002(4), F.A.C. by Michael Dean Sutherland, II. After careful consideration of the facts in this matter, the Commission found that Petitioner had not demonstrated an economic, technological, legal, or other type of hardship resulting from an application of Rule 11B-27.002(4), (F.A.C.) that was particular to petitioner, significantly different from the way the rule affects other similarly situated persons and issued an order denying Petitioner's petition for a 180 day waiver of Rule 11B-27.002(4), (F.A.C.).

Collier County in conjunction with The Florida Department of Transportation District One will host an alternatives public workshop regarding the Project Development and Environment (PD&E) Study being conducted for the Golden Gate Estates Bridges. This meeting will be held on Thursday, December 11, 2014 in the Golden Gate Fire Control and Rescue District Station 71 Training Room, 100 13th Street S.W., Naples, FL 34117 from 5:00 p.m. to 7:00 p.m.
The purpose of this workshop is to afford the public the opportunity to express their views concerning the proposed alternatives. The workshop will be an informal open house. There will be a display of boards and other materials to present examples of the different alternatives. County and Department staff will be available to discuss the project, receive public input and to answer your questions. There will be no formal presentation and participants are welcome to attend anytime between 5 p.m. and 7 p.m.
The alternatives under consideration consist of new bridge crossings over canals at 8th Street N.E. from Golden Gate Blvd. to Randell Blvd., 16th Street N.E. from Golden Gate Blvd. to Randell Blvd. and 47th Ave. N.E. from Immokalee Road to Everglades Blvd., as well as roadway enhancements including sidewalks. These area and corridor enhancements will provide operational and safety improvements, for better emergency response times, evacuation capabilities, and service capabilities to the surrounding area. The increased connectivity provided by these improvements will also increase the efficiency of services provided to the subdivision and allow for greater options for alternative travel routes of resident.

With input from the community, and the engineering and environmental analysis complete, the Intergovernmental Agency has selected a locally preferred alternative that will be presented at the hearing. Attendees will be given an opportunity to review and comment on the locally preferred alternative. A court reporter will be present to record a formal transcript of the hearing. Study limits are Crawfordville Highway to the south and Blountstown Highway to the northwest. Attendees will be given an opportunity to review and comment on the locally preferred alternative.
