The rule chapter is being amended to update the rules and related forms that provide guidance regarding procedures, requirements, and qualifications of banks and savings associations participating as qualified public depositories (“QPDs”) in the state, pursuant to chapter 280, F.S. The proposed rules have been streamlined to improve organization and efficiency in the administration of the rule chapter. The rulemaking provides expanded guidance and criteria regarding a QPD’s request for consideration of hardship claims that may result in the adjustment of a QPD’s current pledge of collateral. The rulemaking also provides that in cases where a non-qualified depository acquires, merges or consolidates with a QPD, the grace period under which the resulting entity is automatically approved as a QPD is increased from thirty (30) days to (90) days. Changes have also been made to the filing and reporting requirements for any such resulting entity seeking to withdraw from participation as a QPD. Additionally, the rulemaking deletes an existing rule, clarifies, updates and deletes certain existing definitions, adds new definitions, updates existing forms, adds new forms, and provides electronic links to the Division’s website.

On November 5, 2019 the Division issued an order. The Final Order was in response to a Petition for an emergency temporary Variance from SSH TRS H LLC d/b/a HOMEWOOD SUITES BY HILTON, filed October 18, 2019, and advertised on October 24, 2019 in Vol. 45, No. 208, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance denies the Petitioner a variance from Rule 212.1, ASME A17.1b, 1998 edition, as adopted by Rule 61C-5.001 Florida Administrative Code that requires minimum hoistway rope size because the Petitioner has not demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW 2019-179).

On October 23, 2019the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Pop Orlando 2 LLC located in Orlando. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink and 3-compartment sink.
The Petition for this variance was published in Vol. 45/113 on June 11, 2019. The Order for this Petition was signed and approved on June 19, 2019. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sinks and 3-compartment sink are emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sinks are provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

That it has issued an order on November 4, 2019, granting U.S. Department of the Interior, National Park Service’s Petition for a Variance. The Petition was received on August 28, 2019. Notice of receipt of this Petition was published in the Florida Administrative Register on September 13, 2019. The petition requested a variance from Rule 62-342.700(15)(b), F.A.C., which requires that a trust fund for perpetual management of a mitigation bank be established using a form that is in substantial conformance with the form incorporated into the Rule. No public comment was received. The Order, OGC No. 19-1517 and DEP File No. 257597-005, granted the Petition to Rule 62-342.700(15)(b), F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.

The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 45/150 on August 2, 2019. The Order for this Petition was signed and approved on August 19, 2019. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within EJ's Pizza (EJ's 1 LLC 9119 Merrill Rd. #17 Jacksonville, FL 32225), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of 904 Catering (904 Catering LLC) and/or EJ's Pizza (EJ's 1 LLC) changes, an updated signed agreement for use of the bathroom facilities will be required immediately.

On October 29, 2019 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Paragraph 4-301.11(A), 2009 FDA Food Code, Paragraph 61C-4.010(5), Florida Administrative Code from KMPG LLP located in Lake Nonat. The above referenced F.A.C. addresses the requirement that adequate cold food storage is provided. They are requesting to share the cold food storage with another food service establishment under the same ownership and on the same premise.
The Petition for this variance was published in Vol. 45/161 on August 19, 2019. The Order for this Petition was signed and approved on September 05, 2019. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the walk in cooler and walk in freezer within KPMG LLP (File: 321601) must be maintained in a clean and sanitary manner. These areas must also be available to KPMG LLP Wine Bar during all hours of operation. If the ownership of KPMG LLP Wine Bar (KPMG LLP) and KPMG LLP Main Kitchen (KPMG LLP) changes, a signed agreement between the two establishments for the use of the shared facilities must be provided to the division immediately.

State Road (S.R.) 50 Design Project – Segments 2 and 3, from east of S.R. 35/U.S. 301 to County Road (C.R.). 478A, Hernando and Sumter Counties, Florida
The Florida Department of Transportation (FDOT) will hold an open house regarding the proposed design for widening S.R. 50 from east of S.R. 35/U.S. 301 in Hernando County to east of C.R. 478A in Sumter County. Based on a Project Development and Environment (PD&E) Study completed in June 2019, the design would widen S.R. 50 from two lanes to four lanes within the project limits.
The PD&E Study evaluated alternatives for four segments of S.R. 50 from U.S. 301/S.R. 35 to C.R. 33 in Hernando, Sumter and Lake Counties. All four segments studied are currently under design. The proposed design being presented at this open house is for two segments: 435859-2, from east of S.R. 35/U.S. 301 and ending at the Hernando/Sumter County line in Hernando County; and 435859-3 beginning at the Hernando/Sumter County line and ending just east of C.R. 478A in Sumter County.
The purpose of this project is to increase capacity on S.R. 50, as well as improve safety along the corridor. This project is part of a greater effort addressing existing and future congestion and delays, improving safety and traffic flow, and allowing the S.R. 50 corridor to operate at an improved level of service for all users. Bicycle and pedestrian facilities are also being evaluated. The need for the project is based on six primary factors: system linkage, roadway capacity, legislation/plan consistency, modal interrelationships, safety, and hurricane evacuation.
The open house will be held on November 14, 2019, at the Ridge Manor Community Center, 34240 Cortez Boulevard, Ridge Manor, FL 33523, from 5:30 p.m. to 7:30 p.m. Interested persons may attend at any time during those hours to view a looping video presentation and project exhibits, speak with project team members, and provide input on the design.
