The Board considered the instant Petition at a duly-noticed public meeting held on August 14, 2012, in Orlando, Florida.
The Board’s Order, filed on October 19, 2012, granted the petition finding that Petitioner established that the purpose of the statute would be met as required by Section 455.225(3), Florida Statutes, in that the Petitioner’s violation did not demonstrate a serious inability to practice the profession, did not result in economic or physical harm to a person, and did not adversely affect the health, safety and welfare of the public. The Board further found that Petitioner established that the Board’s full application of Rule 61J1-8.003(1), F.A.C., to his circumstances would violate principles of fairness and would impose a substantial hardship on him.

The purpose of this prehearing conference is to: (1) simplify the issues; (2) identify the positions of the parties on the issues; (3) consider the possibility of obtaining admissions of fact and of documents which will avoid unnecessary proof; (4) identify exhibits; (5) establish an order of witnesses; and (6) consider such other matters as may aid in the disposition of the action.
GENERAL SUBJECT MATTER TO BE CONSIDERED AT THE HEARING:
The purpose of this hearing is for the Commission to take final action to determine the need, pursuant to Section 403.519, Florida Statutes (F.S.) for modernization of Port Everglades Plant, by Florida Power & Light Company and to consider any motions or other matters that may be pending at the time of the hearing. The Commission may rule on any such motions from the bench or may take the matters under advisement. This proceeding shall: (1) allow Florida Power & Light to present evidence and testimony in support of their petition for a determination of need for the proposed modernization of Port Everglades Plant; (2) permit any intervenors to present testimony and exhibits concerning this matter; (3) permit members of the public who are not parties to the need determination proceeding the opportunity to present testimony concerning this matter; and (4) allow for such other purposes as the Commission may deem appropriate.
PUBLIC TESTIMONY: Any member of the public who wishes to offer testimony should be present at the beginning of the hearing on February 20, 2012. By providing public testimony, a person does not become a party to the proceeding. To become an official party of record, you must file a Petition for Intervention at least five days before the final hearing, pursuant to the requirements contained in Rule 25-22.039, Florida Administrative Code (F.A.C.). All witnesses shall be subject to cross-examination at the conclusion of their testimony.
The hearing will be governed by the provisions of Chapter 120, F.S.; Section 403.519, F.S.; and Chapters 25-22 and 28-106, F.A.C. Only issues relating to the need for the modernization of Port Everglades Plant by Florida Power & Light will be heard at the hearing. Separate public hearings may be held before the Division of Administrative Hearings to consider environmental and other impacts of the proposed power plants, as required by the “Power Plant Siting Act,” Sections 403.501 – 403.519, F.S.

The Petitioner was requesting an interpretation of Chapter 489.105(3)(n), Florida Statutes, and whether the installation of Back Flow prevention devices on the consumer side of a main water distribution system for a single family dwelling is permitted under the license of an underground utility contractor.
The Board’s Order, filed on November 2, 2012, denies issuance of a Declaratory Statement. Petitioner did not demonstrate he is substantially affected, as required by section 120.565, Florida Statues. The Petitioner is a consumer inquiring about previous activity.

The Board considered the Petition at a duly-noticed public meeting held on October 12, 2012. The Petitioner was requesting an interpretation of Chapter 489.105(3)(n), Florida Statutes, and whether proposed activity related to water, sewer, and storm water collection services as set forth in the attached bid contracts requires an underground utility and excavation license.
The Board’s Order, filed on November 2, 2012, denies issuance of a Declaratory Statement. Petitioner did not demonstrate he is substantially affected, as required by section 120.565, Florida Statues. Further the matter appears to involve pending litigation and refers to past activity rather than prospective conduct.

Artesian Pools; The Notice of Petition for Declaratory Statement was published in Volume 38, No. 41, of the October 2, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on October 12, 2012. Petitioner requested the Board to interpret Subsection 489.113(9)(b)2., Florida Statutes, and whether a contractor may submit his or her own site specific drawings, specifications, and plans for permitting residential swimming pools, spas, or screened enclosures not exceeding 1,200 square feet or one story in height without a licensed engineer or architect signing and sealing the drawing; and whether building officials can reject such drawing, specifications, or plans when submitted by a properly licensed contractor via a permit application for work that falls within the scope of the contractor’s license.
The Board’s Order, filed on November 2, 2012, issues a declaratory statement that a contractor may submit his or her own site specific drawings, specifications, and plans for permitting residential swimming pools spas, or screened enclosures not exceeding 1,200 square feet or one story in height without a licensed engineer or architect signing and sealing the drawing; and building officials cannot reject, other than for good cause, such drawing, specifications, or plans when submitted by a properly licensed contractor via a permit application for work that falls within the scope of the contractor’s license.
