The petition requests a waiver from two Coastal Construction Control Line (CCCL) permit application requirements to allow a dune walkover structure on Little Estero Island. Specifically, the Petitioners request a waiver from paragraphs 62B-33.008(3)(c) and (d), F.A.C., which require that applicants provide written evidence, at time of permit application, from the appropriate local governmental entity having jurisdiction over the activity, that the proposed activity as submitted to the Department, does not contravene local setback requirements or zoning codes and documentation of ownership or consent of the landowner of the property where the project is proposed to be located. The amended petition requests that these requirements be a condition of the CCCL permit and submitted to the Department prior to construction. The property consists of two lots located at 8150 and 8170 Estero Boulevard, Fort Myers Beach, Florida. The petition has been assigned File No. LE-1567 V; OGC No. 17-0959.

that it issued an order on November 8, 2017, granting Florida Governmental Utility Authority’s Petition for a Variance. The Petition was received on September 21, 2017. Notice of Receipt of the Petition was published in the Florida Administrative Register on October 9, 2017. The Petitioner requested a renewal for its Lake Fairways Wastewater Treatment Plant (LFWWTP) to further reduce the staffing requirements at its LFWWTP to 6 hours per day, 5 days per week, and one visit of one-hour duration during the weekend from Rule 62-610.462(3) F.A.C., which requires staffing by a Class C or higher operator 6 hours per day, 7 days per week. No public comment was received. Petitioner requested a reduction in the staffing requirement and agreed not to produce public access reuse water on weekends. The Final Order granted a temporary variance because the Petitioner demonstrated that a strict application of the rule would result in a substantial hardship.

FDOT is conducting the CMNAA Study in partnership with the Sarasota/Manatee Metropolitan Planning Organization, Manatee County, Cities of Palmetto and Bradenton, FDOT Central Office (OEM), and local entities. The recommendations of this study will seek to provide residents safer and improved access to jobs, schools, shopping, and social services, and improved regional mobility for all users. The CMNAA Study will produce an implementation plan for an integrated system of recommendations that identifies funding requirements, agency responsibilities, and associated timelines. This will include strategies to program a series of short-term (5-10 year), mid-term (10-15 year), and long-term (15+ year) projects, as well as to identify near-term (0-5 year) opportunities that can be funded and advanced quickly. The study will evaluate options for a possible third bridge, changes in travel patterns in downtown Bradenton to reduce travel times, new sidewalks and bicycle facilities, safety improvements to several roadways and changes to MCAT to improve service.
The project is in Phase 2, preliminary alternatives have been developed and the project team is beginning to screen concepts and eliminate non-viable alternatives. FDOT is seeking public input on the various alternatives. Please note that two or more elected officials may me present at the meeting.
