Petitioner South Florida Racing Association, LLC (SFRA) in DBPR Case No. 2012048823 (DS 2012-089).; The Petition requests the Division of Pari-Mutuel Wagering to state (a.) that Section 550.0745(1), Florida Statutes, as it applies to the SFRA, was not intended to, and does not provide for the Division to issue new summer jai alai permits each time that a permitholder within a county having five or more pari-mutuel permits which has had the smallest play or total pool within the county for two consecutive years (identified by Petitioner as the “Qualifying Permitholder”) declines to convert its permit; and (b.) that if new summer jai alai permits are available pursuant to Section 550.0745(1), Florida Statutes, the Qualifying Permitholder has priority over all other pemitholders in the county to apply for and receive the new summer jai alai permit.
