On December 11, 2019, the Division issued an order. The Final Order was in response to a Petition for a Variance from Cypress Cathedral Apartments, filed November 21, 2019, and advertised on November 26, 2019 in Vol. 45, No.230, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.8.5.1, ASME A17.1, 2009 edition, as adopted by Rule 61C-5.001 Florida Administrative Code that requires air conditioning equipment not be located directly above elevator equipment because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW 2019-195).

On December 11, 2019, the Florida Housing Finance Corporation issued an order granting the variance from Rule 67-48.023(2) F.A.C. for St. Elizabeth Gardens Apartments, Ltd., to allow for calculation of the minimum set aside percentage based on income averaging. Florida Housing determined that the Petitioner had demonstrated that it would suffer a substantial hardship if the waiver was not granted. The petition was filed on September 10, 2019 and notice of the receipt of petition was published on September 12, 2019 in Vol. 45, Number 178, F.A.R.
